Bill Title: Creates the Public Higher Education Act. Defines terms, including "employee", which means an employee of a public institution of higher education who provides educational support services to the institution, including, but not limited to, a custodial employee, a transportation employee, a food service provider, a teaching assistant, or administrative staff. Provides that, in fixing the salaries of employees, the governing board of each public institution of higher education shall pay to employees an hourly rate of not less than: (i) $20 for the 2023-2024 academic year; (ii) $21 for the 2024-2025 academic year; and (iii) $22 for the 2025-2026 academic year. Provides that the minimum hourly rate for each academic year thereafter shall equal the minimum hourly rate for the previous academic year increased by a percentage equal to the percentage increase, if any, in the Consumer Price Index for All Urban Consumers for all items published by the United States Department of Labor for the previous academic year. Amends the School Code to make similar changes. Effective immediately.

1 | AN ACT concerning education.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the Public | ||||||||||||||||||||||||||
5 | Higher Education Act.
| ||||||||||||||||||||||||||
6 | Section 3. Intent. It is the intent of the General | ||||||||||||||||||||||||||
7 | Assembly that the requirements set forth in this Act should | ||||||||||||||||||||||||||
8 | apply equally to each public institution of higher education | ||||||||||||||||||||||||||
9 | in this State and to the governing board of each public | ||||||||||||||||||||||||||
10 | institution of higher education in this State.

11 | Section 5. Definitions. As used in this Act: | ||||||||||||||||||||||||||
12 | "Governing board of each public institution of higher | ||||||||||||||||||||||||||
13 | education" means the Board of Trustees of the University of | ||||||||||||||||||||||||||
14 | Illinois, the Board of Trustees of Southern Illinois | ||||||||||||||||||||||||||
15 | University, the Board of Trustees of Chicago State University, | ||||||||||||||||||||||||||
16 | the Board of Trustees of Eastern Illinois University, the | ||||||||||||||||||||||||||
17 | Board of Trustees of Governors State University, the Board of | ||||||||||||||||||||||||||
18 | Trustees of Illinois State University, the Board of Trustees | ||||||||||||||||||||||||||
19 | of Northeastern Illinois University, the Board of Trustees of | ||||||||||||||||||||||||||
20 | Northern Illinois University, the Board of Trustees of Western | ||||||||||||||||||||||||||
21 | Illinois University, the board of trustees of each community | ||||||||||||||||||||||||||
22 | college district in this State, and the governing board of any |

6 | University, Illinois State University, Northeastern Illinois | ||||||
7 | University, Northern Illinois University, Western Illinois | ||||||
8 | University, a public community college in this State, or any | ||||||
9 | other public university, college, or community college now or | ||||||
10 | hereafter established or authorized by the General Assembly.

11 | Section 10. Minimum salary. | ||||||
12 | (a) As used in this Section, "employee" means an employee | ||||||
13 | of a public institution of higher education who provides | ||||||

4 | Section 90. The School Code is amended by adding Section | ||||||
5 | 24-8.2 as follows:

7 | Sec. 24-8.2. Minimum salary. | ||||||
8 | (a) As used in this Section, "employee" means an employee | ||||||
9 | of the school district who provides educational support | ||||||
10 | services to the district, including, but not limited to, a | ||||||
11 | custodial employee, a transportation employee, a food service | ||||||
12 | provider, a classroom assistant, administrative staff, or a | ||||||
13 | paraprofessional under subparagraph (J) of paragraph (2) of | ||||||
14 | Section 21B-20. | ||||||
15 | (b) In fixing the salaries of employees, a school board | ||||||
16 | shall pay to employees an hourly rate of not less than: (i) $20 | ||||||
17 | for the 2023-2024 school year; (ii) $21 for the 2024-2025 | ||||||
18 | school year; and (iii) $22 for the 2025-2026 school year. The | ||||||
19 | minimum hourly rate for each school year thereafter shall | ||||||
20 | equal the minimum hourly rate for the previous school year | ||||||
