Bill Title: Amends the Tobacco Products Tax Act of 1995. Provides that no licensee under the Act or the licensee's agent or employee shall possess, sell, offer for sale, give away, barter, exchange, or otherwise furnish on the licensed premises any cannabinoid hemp products, or engage in an act of concealment of cannabinoid hemp products on any licensed premises, within an area designated as the Midway Residential Area. Provides that the Department of Revenue shall not issue any new tobacco retailers license or renew any existing tobacco retailers license for a tobacco retailer within the Midway Residential Area.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Tobacco Products Tax Act of 1995 is amended | |||||||||||||||||||||
5 | by adding Sections 10-100 and 10-100.5 as follows:

7 | Sec. 10-100. Cannabinoid hemp products; prohibited areas. | |||||||||||||||||||||
8 | (a) As used in this Section: | |||||||||||||||||||||
9 | "Cannabinoid hemp product" means hemp or any product | |||||||||||||||||||||
10 | manufactured or derived from hemp, including hemp derived | |||||||||||||||||||||
11 | terpenes, in its final form, that is: (1) used for human | |||||||||||||||||||||
12 | consumption, including by ingestion, inhalation, or otherwise; | |||||||||||||||||||||
13 | and (2) capable of producing a psychoactive effect in a person | |||||||||||||||||||||
14 | who consumes it. "Cannabinoid hemp product" shall not include | |||||||||||||||||||||
15 | products intended for topical use. | |||||||||||||||||||||
16 | "Concealment" means to deliberately hide to prevent or | |||||||||||||||||||||
17 | evade discovery. | |||||||||||||||||||||
18 | "Hemp" means the plant Cannabis sativa L. and any part of | |||||||||||||||||||||
19 | such plant, including the seeds thereof and all derivatives, | |||||||||||||||||||||
20 | extracts, cannabinoids, isomers, acids, salts, and salts of | |||||||||||||||||||||
21 | isomers, whether growing or not, that is not cannabis | |||||||||||||||||||||
22 | regulated under the Compassionate Use of Medical Cannabis | |||||||||||||||||||||
23 | Program Act or the Cannabis Regulation and Tax Act. |

1 | "Licensed premises" means the premises or location | ||||||
2 | licensed or required to be licensed under this Act. The term | ||||||
3 | "licensed premises" includes (1) the building where the | ||||||
4 | licensed premises is located; (2) all grounds, areas, and | ||||||
5 | facilities on, in or immediately adjacent to the licensed | ||||||
6 | premises used by, or held out for use by, the licensee or their | ||||||
7 | agent or employee, including, but not limited to, the licensed | ||||||
8 | premises' parking facility; and (3) all vehicles used by the | ||||||
9 | licensee or his agent or employee to conduct the activity | ||||||
10 | licensed or required to be licensed under this Section. | ||||||
11 | "Midway Residential Area" means that portion of the City | ||||||
12 | of Chicago bounded as follows: Beginning at the intersection | ||||||
13 | of 65th Street and Harlem Avenue, thence north on Harlem | ||||||
14 | Avenue to Illinois Central Railroad, thence northeast along | ||||||
15 | the Illinois Central Railroad to 51st Street, thence east on | ||||||
16 | 51st Street to Laramie Avenue, thence north on Laramie Avenue | ||||||
17 | to 50th Street, thence east on 50th Street to Cicero Avenue, | ||||||
18 | thence south on Cicero Avenue to 51st Street, thence east on | ||||||
19 | 51st Street to Kolin Avenue, thence south on Kolin Avenue to | ||||||
20 | Archer Avenue, thence northeast on Archer Avenue to Kildare | ||||||
21 | Avenue, thence south on Kildare Avenue to 51st Street, thence | ||||||
22 | east on 51st Street to Harding Avenue, thence south on Harding | ||||||
23 | Avenue to the alley south of 51st Street, thence east on the | ||||||
24 | alley south of 51st Street to Lawndale Avenue, thence north on | ||||||
25 | Lawndale Avenue to 51st Street, thence east along 51st Street | ||||||

11 | Avenue, thence north on Cicero Avenue to 65th Street, thence | ||||||
12 | west on 65th Street to Harlem Avenue. | ||||||
13 | (b) No licensee under this Act or the licensee's agent or | ||||||
14 | employee shall possess, sell, offer for sale, give away, | ||||||
15 | barter, exchange, or otherwise furnish on the licensed | ||||||
16 | premises any cannabinoid hemp products, or engage in an act of | ||||||
17 | concealment of cannabinoid hemp products on any licensed | ||||||
18 | premises, within the Midway Residential Area. | ||||||
19 | (c) Except as otherwise provided in this Act, any person | ||||||
20 | who violates any of the requirements of this Section or any | ||||||
21 | rule adopted under this Section shall be fined not less than | ||||||
22 | $2,000 nor more than $5,000 for each offense. Each day that a | ||||||
23 | violation continues shall constitute a separate and distinct | ||||||
24 | offense to which a separate fine shall apply. | ||||||
25 | (d) Any violation of this Section or any rule adopted | ||||||
26 | under this Section may result in license suspension or |
