Bill Title: Amends the Tobacco Products Tax Act of 1995. Provides that no licensee under the Act or the licensee's agent or employee shall possess, sell, offer for sale, give away, barter, exchange, or otherwise furnish on the licensed premises any cannabinoid hemp products, or engage in an act of concealment of cannabinoid hemp products on any licensed premises, within an area designated as the Midway Residential Area. Provides that the Department of Revenue shall not issue any new tobacco retailers license or renew any existing tobacco retailers license for a tobacco retailer within the Midway Residential Area.

Amends the Tobacco Products Tax Act of 1995. Provides that no licensee under the Act or the licensee's agent or employee shall possess, sell, offer for sale, give away, barter, exchange, or otherwise furnish on the licensed premises any cannabinoid hemp products, or engage in an act of concealment of cannabinoid hemp products on any licensed premises, within an area designated as the Midway Residential Area. 1 AN ACT concerning revenue.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Tobacco Products Tax Act of 1995 is amended
5by adding Sections 10-100 and 10-100.5 as follows:
6 (35 ILCS 143/10-100 new)
7 Sec. 10-100. Cannabinoid hemp products; prohibited areas.
8 (a) As used in this Section:
9 "Cannabinoid hemp product" means hemp or any product
10manufactured or derived from hemp, including hemp derived
11terpenes, in its final form, that is: (1) used for human
12consumption, including by ingestion, inhalation, or otherwise;
13and (2) capable of producing a psychoactive effect in a person
14who consumes it. "Cannabinoid hemp product" shall not include
15products intended for topical use.
16 "Concealment" means to deliberately hide to prevent or
17evade discovery.
18 "Hemp" means the plant Cannabis sativa L. and any part of
19such plant, including the seeds thereof and all derivatives,
20extracts, cannabinoids, isomers, acids, salts, and salts of
21isomers, whether growing or not, that is not cannabis
22regulated under the Compassionate Use of Medical Cannabis
23Program Act or the Cannabis Regulation and Tax Act.

1 "Licensed premises" means the premises or location
2licensed or required to be licensed under this Act. The term
3"licensed premises" includes (1) the building where the
4licensed premises is located; (2) all grounds, areas, and
5facilities on, in or immediately adjacent to the licensed
6premises used by, or held out for use by, the licensee or their
7agent or employee, including, but not limited to, the licensed
8premises' parking facility; and (3) all vehicles used by the
9licensee or his agent or employee to conduct the activity
10licensed or required to be licensed under this Section.
11 "Midway Residential Area" means that portion of the City
12of Chicago bounded as follows: Beginning at the intersection
13of 65th Street and Harlem Avenue, thence north on Harlem
14Avenue to Illinois Central Railroad, thence northeast along
15the Illinois Central Railroad to 51st Street, thence east on
1651st Street to Laramie Avenue, thence north on Laramie Avenue
17to 50th Street, thence east on 50th Street to Cicero Avenue,
18thence south on Cicero Avenue to 51st Street, thence east on
1951st Street to Kolin Avenue, thence south on Kolin Avenue to
20Archer Avenue, thence northeast on Archer Avenue to Kildare
21Avenue, thence south on Kildare Avenue to 51st Street, thence
22east on 51st Street to Harding Avenue, thence south on Harding
23Avenue to the alley south of 51st Street, thence east on the
24alley south of 51st Street to Lawndale Avenue, thence north on
25Lawndale Avenue to 51st Street, thence east along 51st Street
26extended east to the Grand Trunk Western Railroad, thence

1south along the Grand Trunk Western Railroad to 59th Street,
2thence east on 59th Street to Central Park Avenue, thence

6Grand Trunk Western Railroad, thence south along the Grand
7Trunk Railroad to a line extending west from the intersection
8of 75th Street and Central Park Avenue, then west along such
9line to Pulaski Road, thence north on Pulaski Road to 71st
10Street, thence west on 71st Street as extended to Cicero
11Avenue, thence north on Cicero Avenue to 65th Street, thence
12west on 65th Street to Harlem Avenue.
13 (b) No licensee under this Act or the licensee's agent or
14employee shall possess, sell, offer for sale, give away,
15barter, exchange, or otherwise furnish on the licensed
16premises any cannabinoid hemp products, or engage in an act of
17concealment of cannabinoid hemp products on any licensed
18premises, within the Midway Residential Area.
19 (c) Except as otherwise provided in this Act, any person
20who violates any of the requirements of this Section or any
21rule adopted under this Section shall be fined not less than
22$2,000 nor more than $5,000 for each offense. Each day that a
23violation continues shall constitute a separate and distinct
24offense to which a separate fine shall apply.
25 (d) Any violation of this Section or any rule adopted
26under this Section may result in license suspension or

1revocation in accordance with the requirements of Section
210-25 or 10-50.
