Bill Title: Amends the Mental Health and Developmental Disabilities Administrative Act. Requires the Department of Human Services to record the menstrual cycles of every woman of child-bearing age who is admitted to and remains in a mental health facility for more than 60 days. Effective immediately.

AN ACT concerning State government.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 5. The Mental Health and Developmental | ||||
Disabilities Administrative Act is amended by changing Section | ||||
10.1 as follows:

Sec. 10.1.
Every woman of child-bearing age who
is admitted | ||||
to a facility under the jurisdiction of the Department shall,
| ||||
with her consent or the consent of her guardian, be
tested for | ||||
pregnancy upon admission and thereafter as indicated. For a | ||||
recipient who is admitted to and remains in a facility for more | ||||
than 60 days a A record
of each such recipient's menstrual | ||||
cycles shall be maintained. A plan for
complete prenatal care | ||||
shall be developed and implemented for each
recipient who is | ||||
found to be pregnant. On-site prenatal care shall be
provided | ||||
to recipients who are not verbal or who otherwise cannot
| ||||
communicate with a provider of care because of a severe | ||||
disability, in
which case the facility administrator shall also | ||||
seek the consent of the
recipient's legal guardian for special | ||||
care for the recipient, or shall
arrange for a temporary or | ||||
limited guardianship of the person of the
recipient for the | ||||
purpose of obtaining consent to diagnosis and treatment
of the |
recipient. Discharge planning for a pregnant recipient shall

specifically include provision for continuity of prenatal | ||
care.

Section 99. Effective date. This Act takes effect upon | ||
becoming law.
