Bill Title: Amends the Pharmacy Practice Act. Provides that beginning July 1, 2015, every new or refilled prescription for a Schedule II controlled substance shall only be dispensed in a medicine locking closure package. Defines "medicine locking closure package" and "Schedule II controlled substance". Provides that the medicine locking closure package may not be reusable. Provides that the medicine locking closure package must be dispensed by the pharmacy with instructions for patient use. Provides that the manufacturer of the medicine locking closure package must make assistance available online or through a toll-free number for patients. Effective immediately.

1 AN ACT concerning regulation.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Pharmacy Practice Act is amended by adding
5Section 16c as follows:
6 (225 ILCS 85/16c new)
7 Sec. 16c. Medicine locking closure package.
8 (a) As used in this Section:
9 "Medicine locking closure package" means any alphanumeric
10combination locking closure mechanism that can only be unlocked
11with a user-generated, resettable alphanumeric code in
12combination with an amber prescription container that forms a
13package that allows only the person with the prescription in
14the package access to the medicine.
15 "Schedule II controlled substance" means a Schedule II
16controlled substance under the United States Controlled
17Substances Act and 21 CFR 1308.
18 (b) Beginning July 1, 2015, every new or refilled
19prescription for a Schedule II controlled substance shall only
20be dispensed in a medicine locking closure package. The
21medicine locking closure package may not be reusable. The
22medicine locking closure package must be dispensed by the
23pharmacy with instructions for patient use. The manufacturer of

4 Section 99. Effective date. This Act takes effect upon
5becoming law.
