Bill Title: Creates the 72-Hour Bill Review Act. Sets forth time requirements during which legislation must be made publicly available before passage. Provides that the time requirements may be waived by an affirmative two-thirds vote of the full committee or chamber considering the legislation. Effective immediately.

1 | AN ACT concerning State government.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the | ||||||||||||||||||||||||
5 | 72-Hour Bill Review Act.

6 | Section 5. Definitions. As used in this Act: | ||||||||||||||||||||||||
7 | "Amendment" means any proposed change to a bill. | ||||||||||||||||||||||||
8 | "Publicly available" means available for viewing on the | ||||||||||||||||||||||||
9 | General Assembly's Internet website and published in a bill | ||||||||||||||||||||||||
10 | report, committee report, or conference-committee report. | ||||||||||||||||||||||||
11 | "Striking amendment" means any amendment removing and | ||||||||||||||||||||||||
12 | replacing everything after the enacting clause of a bill.

13 | Section 10. Hearing or votes prohibited for 72 hours. A | ||||||||||||||||||||||||
14 | hearing or vote on any bill is prohibited for at least 72 hours | ||||||||||||||||||||||||
15 | after the bill is made publicly available. This 72-hour period | ||||||||||||||||||||||||
16 | excludes Saturdays, Sundays, and holidays unless the chamber | ||||||||||||||||||||||||
17 | considering the bill is in session on that day.

18 | Section 15. Adoption of amendments and striking | ||||||||||||||||||||||||
19 | amendments. | ||||||||||||||||||||||||
20 | (a) A vote on an amendment to a bill is not in order unless | ||||||||||||||||||||||||
21 | that amendment is made publicly available at least 24 hours |

1 | prior to the vote. This 24-hour period excludes Saturdays, | ||||||
2 | Sundays, and holidays unless the chamber considering the bill | ||||||
3 | is in session on that day. | ||||||
4 | (b) A vote on a striking amendment to a bill is not in | ||||||
5 | order unless that amendment is made publicly available at least | ||||||
6 | 48 hours prior to the vote. This 48-hour period excludes | ||||||
7 | Saturdays, Sundays, and holidays unless the chamber | ||||||
8 | considering the bill is in session on that day.

9 | Section 20. Application to multiple stages of | ||||||
10 | consideration. The time limitations in this Act apply each time | ||||||
11 | a new version of a bill is considered. This includes | ||||||
12 | consideration of conference-committee recommendations.

13 | Section 25. Exceptions. The time limitation of this Act may | ||||||
14 | be waived by an affirmative two-thirds vote of the full | ||||||
15 | committee or chamber considering the legislation. For any such | ||||||
16 | legislation, the following statement with respect to the | ||||||
17 | legislation must be included in any bill report and on the | ||||||
18 | General Assembly's Internet website: | ||||||
19 | The (insert the chamber or committee) has waived the | ||||||
20 | People's right for a detailed review of this legislation, | ||||||
21 | as required under the 72-Hour Budget Review Act.

22 | Section 99. Effective date. This Act takes effect upon | ||||||
23 | becoming law.
