Bill Title: Amends the Illinois Municipal Retirement Fund (IMRF) Article of the Illinois Pension Code. Provides that the counting of ballots for the election of employee and annuitant trustees shall be open to observers from associations that represent participating municipalities and instrumentalities and labor organizations that represent employees from participating municipalities and instrumentalities. Effective immediately.

1 | AN ACT concerning public employee benefits.
| ||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Pension Code is amended by changing | ||||||||||||||||||||||||
5 | Section 7-175.1 as follows:

6 | (40 ILCS 5/7-175.1) (from Ch. 108 1/2, par. 7-175.1)

7 | Sec. 7-175.1. Election of employee and annuitant trustees.
| ||||||||||||||||||||||||
8 | (a) The board shall prepare and send ballots and ballot | ||||||||||||||||||||||||
9 | envelopes to the
employees and annuitants eligible to vote as | ||||||||||||||||||||||||
10 | of September of that
year. The ballots shall contain the names | ||||||||||||||||||||||||
11 | of all candidates in alphabetical
order and an appropriate | ||||||||||||||||||||||||
12 | place where a name may be written in on
the ballot.
The ballot | ||||||||||||||||||||||||
13 | envelope shall have on the outside a form of certificate | ||||||||||||||||||||||||
14 | stating
that the person voting the ballot is a participating | ||||||||||||||||||||||||
15 | employee or annuitant
entitled to vote.

16 | (b) Employees and annuitants, upon receipt of the ballot, | ||||||||||||||||||||||||
17 | shall vote the
ballot and place it in the ballot envelope, seal | ||||||||||||||||||||||||
18 | the envelope, execute the
certificate thereon and return the | ||||||||||||||||||||||||
19 | ballot to the Fund.

20 | (c) The board shall set a final date for ballot return, and | ||||||||||||||||||||||||
21 | ballots
received prior to that date in a ballot envelope with a
| ||||||||||||||||||||||||
22 | properly executed certificate and properly voted, shall be | ||||||||||||||||||||||||
23 | valid ballots.

1 | (d) The board shall set a day for counting the ballots and
| ||||||
2 | name judges and clerks of election to conduct the count of | ||||||
3 | ballots, and shall
make any rules and regulations necessary for | ||||||
4 | the conduct of the
count.
| ||||||
5 | (d-5) The counting of ballots shall be open to observers | ||||||
6 | from associations that represent participating municipalities | ||||||
7 | and instrumentalities and labor organizations that represent | ||||||
8 | employees from participating municipalities and | ||||||
9 | instrumentalities. | ||||||
10 | (e) No election under this Section shall be required if a | ||||||
11 | candidate is deemed the winner under subsection (g) of Section | ||||||
12 | 7-175. | ||||||
13 | (f) Nothing in this Section shall preclude the Board from | ||||||
14 | adopting rules that provide for Internet balloting or phone | ||||||
15 | balloting in addition to election by mail under this Section. | ||||||
16 | An Internet or phone ballot cast in accordance with rules | ||||||
17 | adopted under this subsection shall be a valid ballot. | ||||||

19 | Section 99. Effective date. This Act takes effect upon | ||||||
20 | becoming law.
