| 2 | AMENDMENT NO. ______. Amend House Bill 4584 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Navigator Certification Act is amended by | ||||||
| 5 | adding Section 22 as follows:
| ||||||
| 6 | (215 ILCS 121/22 new) | ||||||
| 7 | Sec. 22. Criminal history record
check; application for | ||||||
| 8 | certificate and certificate renewal. | ||||||
| 9 | (a) For the purpose of this Section, "fingerprints" means | ||||||
| 10 | an impression of the lines on the finger taken for the purpose | ||||||
| 11 | of identification. The impression may be electronic or in ink | ||||||
| 12 | converted to electronic format. | ||||||
| 13 | (b) In order to make a determination of certification | ||||||
| 14 | eligibility, the Director is authorized to require all | ||||||
| 15 | applicants for a certificate to undergo a fingerprint-based | ||||||
| 16 | criminal history record check for an initial certificate and, | ||||||
| |||||||
| |||||||
| 1 | for an individual holding a certificate on the effective date | ||||||
| 2 | of this amendatory Act of the 98th General Assembly, for the | ||||||
| 3 | first renewal of a certificate. The applicant shall submit his | ||||||
| 4 | or her fingerprints to the Department of State Police in the | ||||||
| 5 | form and manner prescribed by the Department of State Police. | ||||||
| 6 | The fingerprints shall be transmitted by a live scan | ||||||
| 7 | fingerprint vendor licensed by the Department of Financial and | ||||||
| 8 | Professional Regulation. The fingerprints shall be checked | ||||||
| 9 | against the fingerprint records filed in the Department of | ||||||
| 10 | State Police and Federal Bureau of Investigation criminal | ||||||
| 11 | history records databases. The Department of State Police shall | ||||||
| 12 | charge a fee for conducting the criminal history record check, | ||||||
| 13 | which shall be deposited in the State Police Services Fund and | ||||||
| 14 | shall not exceed the actual cost of the State and national | ||||||
| 15 | criminal history record check. The Department of State Police | ||||||
| 16 | shall furnish, pursuant to positive identification, all | ||||||
| 17 | Illinois conviction information to the Department of Insurance | ||||||
| 18 | and shall forward the national criminal history record | ||||||
| 19 | information to the Department of Insurance.".
