Bill Title: Amends the State Finance Act if and only if Senate Bill 1433 of the 96th General Assembly becomes law. Removes a provision of Senate Bill 1433 that authorizes the transfer of $10,400,000 from the Fire Prevention Fund to the General Revenue Fund. Effective immediately.

2 | Be it enacted by the People of the State of Illinois,

4 | Section 5. If and only if Senate Bill 1433 of the 96th | ||||||||||||||||||||||||
5 | General Assembly becomes law, then the State Finance Act is | ||||||||||||||||||||||||
6 | amended by changing Section 8.49 as follows:

9 | (a) In order to maintain the integrity of special funds and | ||||||||||||||||||||||||

23 | All of these transfers shall be made in equal quarterly | ||||||
24 | installments with the first made on July 1, 2009, or as soon | ||||||
25 | thereafter as practical, and with the remaining transfers to be | ||||||
26 | made on October 1, January 1, and April 1, or as soon |

1 | thereafter as practical. These transfers shall be made | ||||||
2 | notwithstanding any other provision of State law to the | ||||||
3 | contrary. | ||||||
4 | (b) On and after the effective date of this amendatory Act | ||||||
5 | of the 96th General Assembly through June 30, 2010, when any of | ||||||
6 | the funds listed in subsection (a) have insufficient cash from | ||||||
7 | which the State Comptroller may make expenditures properly | ||||||
8 | supported by appropriations from the fund, then the State | ||||||
9 | Treasurer and State Comptroller shall transfer from the General | ||||||
10 | Revenue Fund to the fund only such amount as is immediately | ||||||
11 | necessary to satisfy outstanding expenditure obligations on a | ||||||
12 | timely basis, subject to the provisions of the State Prompt | ||||||
13 | Payment Act. All or a portion of the amounts transferred from | ||||||
14 | the General Revenue Fund to a fund pursuant to this subsection | ||||||
15 | (b) from time to time may be re-transferred by the State | ||||||
16 | Comptroller and the State Treasurer from the receiving fund | ||||||
17 | into the General Revenue Fund as soon as and to the extent that | ||||||
18 | deposits are made into or receipts are collected by the | ||||||
19 | receiving fund.

21 | Section 99. Effective date. This Act takes effect upon | ||||||
22 | becoming law.
