Bill Title: Amends the Property Tax Code. Provides that the notice of judgment and sale shall also be sent by first class mail (currently, registered or certified mail only). Provides that, if any notice is returned as undeliverable and includes an updated mailing address, the county collector shall mail a second notice to the new address. Provides that the collector shall collect $30 (currently, $10) from each tax purchaser prior to the issuance of any certificate of purchase to cover the costs of mailing. Effective January 1, 2021.

1 | AN ACT concerning revenue.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Property Tax Code is amended by changing | ||||||||||||||||||||||||
5 | Section 21-135 as follows:
| ||||||||||||||||||||||||

7 | Sec. 21-135. Mailed notice of application for judgment and | ||||||||||||||||||||||||
8 | sale. Not less
than 15 days before the date of application for | ||||||||||||||||||||||||
9 | judgment and sale of delinquent
properties, the county | ||||||||||||||||||||||||
10 | collector shall mail, by registered or certified mail and by | ||||||||||||||||||||||||
11 | first class mail , a
notice of the forthcoming application for | ||||||||||||||||||||||||
12 | judgment and sale to the person shown
by the current | ||||||||||||||||||||||||
13 | collector's warrant book to be the party in whose name the | ||||||||||||||||||||||||
14 | taxes
were last assessed or to the current owner of record and, | ||||||||||||||||||||||||
15 | if applicable, to the party specified under Section
15-170. The | ||||||||||||||||||||||||
16 | notice shall include the intended dates of application for | ||||||||||||||||||||||||
17 | judgment
and sale and commencement of the sale, and a | ||||||||||||||||||||||||
18 | description of the properties. If any notice is returned as | ||||||||||||||||||||||||
19 | undeliverable and includes an updated mailing address, the | ||||||||||||||||||||||||
20 | county collector shall mail a second notice to the new address | ||||||||||||||||||||||||
21 | by registered or certified mail and by first class mail. The | ||||||||||||||||||||||||
22 | second notice does not change the date of application for | ||||||||||||||||||||||||
23 | judgment and sale stated in the original notice. The

1 | collector must present proof of the mailing or mailings and any | ||||||
2 | returned mail to the court along with the
application for | ||||||
3 | judgement.
| ||||||
4 | In counties with less than 3,000,000 inhabitants, a copy of | ||||||
5 | this notice shall
also be mailed by the county collector by | ||||||
6 | registered or certified mail to any
lienholder of record who | ||||||
7 | annually requests a copy of the notice. The failure of
the | ||||||
8 | county collector to mail a notice or its non-delivery to the | ||||||
9 | lienholder
shall not affect the validity of the judgment.

10 | In counties with 3,000,000 or more inhabitants, notice | ||||||
11 | shall not be mailed to
any person when, under Section 14-15, a | ||||||
12 | certificate of error has been executed
by the county assessor | ||||||
13 | or by both the
county assessor and board of
appeals (until the | ||||||
14 | first Monday in December 1998 and the board of
review
beginning
| ||||||
15 | the first Monday in December 1998 and thereafter),
except as | ||||||
16 | provided by court order under Section 21-120.

17 | The collector shall collect $30 from each person purchasing | ||||||
18 | any property at a sale under this Code prior to the issuance of | ||||||
19 | any certificate of purchase $10 from the proceeds of each sale | ||||||
20 | to cover
the costs of registered or certified mailing and the | ||||||
21 | costs of advertisement
and publication.
If a taxpayer pays the | ||||||
22 | taxes on the property after the notice of the
forthcoming | ||||||
23 | application for judgment and sale is mailed but before the sale | ||||||
24 | is
made, then the collector shall collect $10 from the taxpayer | ||||||
25 | to cover the costs
of registered or certified mailing and the | ||||||
26 | costs of advertisement and
publication.
