Bill Title: Creates the Small Single-Use Plastic Bottle Act. Provides that, beginning July 1, 2025, hotels with 50 rooms or more and, beginning January 1, 2026, hotels with less than 50 rooms may not provide small single-use plastic bottles containing personal care products to either (i) a customer of the establishment who is staying in a sleeping room accommodation or any space within the sleeping room accommodation or (ii) a customer of the establishment who is using a bathroom shared by the public or guests. Establishes civil penalties. Defines terms.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the Small | |||||||||||||||||||
5 | Single-Use Plastic Bottle Act.

6 | Section 5. Definitions. As used in this Act: | |||||||||||||||||||
7 | "Hotel" has the meaning given to it in the Hotel | |||||||||||||||||||
8 | Operators' Occupation Tax Act. | |||||||||||||||||||
9 | "Personal care product" means shampoo, hair conditioner, | |||||||||||||||||||
10 | or bath soap that is intended to be applied to or used on the | |||||||||||||||||||
11 | human body in the shower, bath, or any part thereof. | |||||||||||||||||||
12 | "Small single-use plastic bottle" means a plastic bottle | |||||||||||||||||||
13 | or container with less than a 6-ounce capacity that is | |||||||||||||||||||
14 | intended to be nonreusable by the end user.

15 | Section 10. Small single-use plastic bottles at hotels. | |||||||||||||||||||
16 | (a) Beginning July 1, 2025, a hotel with 50 rooms or more | |||||||||||||||||||
17 | must not provide small single-use plastic bottles containing | |||||||||||||||||||
18 | personal care products to either a customer of the | |||||||||||||||||||
19 | establishment who is staying in a sleeping room accommodation | |||||||||||||||||||
20 | or any space within the sleeping room accommodation or a | |||||||||||||||||||
21 | customer of the establishment who is using a bathroom shared | |||||||||||||||||||
22 | by the public or guests. |

1 | (b) Beginning January 1, 2026, a hotel with less than 50 | ||||||
2 | rooms must not provide small single-use plastic bottles | ||||||
3 | containing personal care products to either a customer of the | ||||||
4 | establishment who is staying in a sleeping room accommodation | ||||||
5 | or in any space within the sleeping room accommodation or a | ||||||
6 | customer of the establishment who is using a bathroom shared | ||||||
7 | by the public or guests. | ||||||
8 | (c) A hotel may provide personal care products in small | ||||||
9 | single-use plastic bottles to a person, at no cost, upon | ||||||
10 | request, at a place other than a sleeping room accommodation, | ||||||
11 | a space within the sleeping room accommodation, or a bathroom | ||||||
12 | shared by the public or guests. | ||||||
13 | (d) A unit of local government, including a home rule | ||||||
14 | unit, must not pass an ordinance, resolution, or rule | ||||||
15 | prohibiting a hotel from providing small single-use plastic | ||||||
16 | bottles containing personal care products to customers. This | ||||||
17 | Act is a denial and limitation of home rule powers and | ||||||
18 | functions under subsection (g) of Section 6 of Article VII of | ||||||
19 | the Illinois Constitution.

20 | Section 15. Civil penalties. | ||||||
21 | (a) A hotel that violates this Act is a liable for a | ||||||
22 | written warning for a first violation of this Act and is liable | ||||||
23 | for a civil penalty of $500 for a second or subsequent | ||||||
24 | violation. The written warning shall recite the violation and | ||||||
25 | advise that subsequent violations may result in citations and |
