Bill Title: Amends the Illinois Certified Shorthand Reporters Act of 1984. Requires the Department of Financial and Professional Regulation or a designated testing service to administer the examination for certified shorthand reporters at least 5 times per year. Requires applicants to demonstrate, at a minimum, the ability to record and transcribe general dictation at 200 words per minute for 5 minutes at 85% accuracy and testimony in 2 voices at 225 words per minute for 5 minutes at 85% accuracy.

1 | AN ACT concerning regulation.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Certified Shorthand Reporters Act | |||||||||||||||||||||
5 | of 1984 is amended by changing Sections 10 and 11 as follows:

8 | Sec. 10.
The Department shall authorize examinations at | |||||||||||||||||||||
9 | such time and place as it may designate. However, the | |||||||||||||||||||||
10 | Department or a designated testing service shall administer the | |||||||||||||||||||||
11 | examination at least 5 times per year. The examination shall be
| |||||||||||||||||||||
12 | of a character to give a fair test of the qualifications of the | |||||||||||||||||||||
13 | applicant
to practice shorthand reporting.

14 | Applicants for examination as certified shorthand | |||||||||||||||||||||
15 | reporters shall be required
to pay, either to the Department or | |||||||||||||||||||||
16 | the designated testing service, a fee
covering the cost of | |||||||||||||||||||||
17 | providing the examination. Failure to appear for the
| |||||||||||||||||||||
18 | examination on the scheduled date, at the time and place | |||||||||||||||||||||
19 | specified, after
the applicant's application for examination | |||||||||||||||||||||
20 | has been received and acknowledged
by the Department or the | |||||||||||||||||||||
21 | designated testing service, shall result in the
forfeiture of | |||||||||||||||||||||
22 | the examination fee.

23 | If an applicant neglects, fails or refuses to take the next |
| |||||||
| |||||||
1 | available
examination offered or fails to pass an examination | ||||||
2 | for certification
under this Act, the application shall be | ||||||
3 | denied. If an applicant for
examination for certification under | ||||||
4 | this Act fails to pass the examination
within 3 years after | ||||||
5 | filing his application, the application shall be
denied. | ||||||
6 | However, such applicant may thereafter make a new application
| ||||||
7 | accompanied by the required fee.
| ||||||
8 | The Department may employ consultants for the purpose of | ||||||
9 | preparing and
conducting examinations.
| ||||||
10 | An applicant has one year from the date of notification of
| ||||||
11 | successful completion of the examination to apply to the | ||||||
12 | Department for a
license. If an applicant fails to apply within | ||||||
13 | one year, the applicant shall
be required to take and pass the | ||||||
14 | examination again unless licensed in
another jurisdiction of | ||||||
15 | the United States within one year of passing the
examination.

19 | Sec. 11. Qualifications; application. A person shall be | ||||||
20 | qualified for certification as a certified
shorthand reporter | ||||||
21 | if:
| ||||||
22 | A. That person has applied in writing in form and | ||||||
23 | substance to the
Department ; and :
| ||||||
24 | (1) (Blank);
| ||||||
25 | (2) Is of good moral character, the determination |
| |||||||
| |||||||
1 | of which shall take
into account but not be totally | ||||||
2 | based upon any felony conviction of the
applicant; and
| ||||||
3 | (3) Has graduated from a high school or secondary | ||||||
4 | school or its
equivalent; and
| ||||||
5 | B. That person has successfully completed the examination | ||||||
6 | authorized by
the Department ; for a person to successfully | ||||||
7 | complete the examination, he or she must demonstrate, at a | ||||||
8 | minimum, the ability to record and transcribe general dictation | ||||||
9 | at 200 words per minute for 5 minutes at 85% accuracy and | ||||||
10 | testimony in 2 voices at 225 words per minute for 5 minutes at | ||||||
11 | 85% accuracy .
