2 | AMENDMENT NO. ______. Amend House Bill 4896 by replacing | ||||||
3 | everything after the enacting clause with the following:

4 | "Section 5. The Personnel Code is amended by adding Section | ||||||
5 | 26 as follows:
| ||||||
6 | (20 ILCS 415/26 new) | ||||||
7 | Sec. 26. Reinstatement; Department of Corrections. | ||||||
8 | (a) The Department of Corrections shall provide for the | ||||||
9 | reinstatement of former certified employees who had resigned, | ||||||
10 | who were terminated in good standing, or whose positions were | ||||||
11 | reallocated downward. | ||||||
12 | (b) If an employee who had resigned, who was terminated in | ||||||
13 | good standing, or whose position was reallocated downward | ||||||
14 | reapplies for a position, the Department of Corrections, with | ||||||
15 | prior approval from the Department of Central Management | ||||||
16 | Services, must consider the employee before all other |

1 | applicants. Such reinstatement may be to a position in the | ||||||
2 | class to which the employee was assigned prior to resignation, | ||||||
3 | termination, or downward allocation, or to a position in any | ||||||
4 | other position class for which the employee is qualified. | ||||||
5 | (c) A certified employee whose name appears on a | ||||||
6 | reemployment list may be reinstated to a position other than | ||||||
7 | the position to which the employee is eligible for | ||||||
8 | reemployment. If reinstated to a position in a higher pay grade | ||||||
9 | than that for which the employee is eligible for reemployment, | ||||||
10 | then, upon satisfactory completion of a 3-month probationary | ||||||
11 | period, the employee's name shall be removed from the | ||||||
12 | reemployment list. If an employee is reinstated to a position | ||||||
13 | in a lower pay grade than that for which the employee is | ||||||
14 | eligible for reemployment, it shall have no effect on the | ||||||
15 | employee's reemployment rights. | ||||||
16 | (d) The Department of Corrections shall determine | ||||||
17 | eligibility for vacation time and other benefits based on prior | ||||||
18 | length of service of the former employees who are eligible for | ||||||
19 | reinstatement. | ||||||
20 | (e) The Director of Corrections may reinstate an employee | ||||||
21 | who was formerly certified under the Secretary of State Merit | ||||||
22 | Employment Code, the University Civil Service System of | ||||||
23 | Illinois, the Comptroller Merit Employment Code, or the State | ||||||
24 | Treasurer Employment Code.

25 | Section 99. Effective date. This Act takes effect upon |
