Bill Title: Amends the Clerks of Courts Act. Provides that when the circuit clerk is required to provide notice to a party, and the party has registered an electronic address with the circuit clerk, the circuit clerk may provide the notice via the electronic address. Provides that the circuit clerk shall maintain a copy of the electronic content and a delivery receipt in his or her records. Provides that electronic notices shall have the same effect as a hard copy notice. Effective immediately.

1 AN ACT concerning courts.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Clerks of Courts Act is amended by adding
5 Section 12.1 as follows:
6 (705 ILCS 105/12.1 new)
7 Sec. 12.1. Electronic notice. The circuit clerk may provide
8 notice to a party by hard copy or by electronic notice,
9 pursuant to a uniform and standard policy adopted by the
10 circuit clerk. A recipient may elect to receive notices by hard
11 copy or electronically via the electronic address he or she has
12 registered with the circuit clerk. The clerk must provide
13 notice in the format chosen by the recipient. When providing
14 notice electronically, the circuit clerk shall maintain a copy
15 of the electronic content and a delivery receipt as part of the
16 records of his or her office. Administrative communications of
17 either the clerk or the court are not subject to the electronic
18 notice requirements. If all policies and statutes are complied
19 with, electronic notices shall have the same effect as hard
20 copy notices.
21 Section 99. Effective date. This Act takes effect upon
22 becoming law.
