Amends the Illinois Municipal Code. Provides that a municipally owned water utility may not charge a fee to reconnect water following a water disconnection. Limits home rule powers.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Municipal Code is amended by
5adding Section 11-150-3 as follows:
6 (65 ILCS 5/11-150-3 new)
7 Sec. 11-150-3. Water reconnection fee.
8 (a) A municipally owned water utility may not charge a fee
9to reconnect water following a water disconnection.
10 (b) The charging of water reconnection fees are exclusive
11powers and functions of the State. A home rule or non-home rule
12municipality may not charge a water reconnection fee. This
13Section is a denial and limitation of home rule powers and
14functions under subsection (h) of Section 6 of Article VII of
15the Illinois Constitution.
