AN ACT concerning business.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Consumer Fraud and Deceptive Business
Practices Act is amended by adding Section 2WWW as follows:
(815 ILCS 505/2WWW new)
Sec. 2WWW. Internet customer confidentiality.
(a) As used in this Section, "Internet service provider"
means any person, business, or organization qualified to do
business in this State that provides individuals,
corporations, or other entities with the ability to connect to
the Internet through equipment that is located in this State.
(b) An Internet service provider offering services to
Illinois consumers shall keep all customer information
confidential unless the customer provides written consent to a
disclosure.
(c) An Internet service provider that violates this Section
commits an unlawful practice within the meaning of this Act
and, in addition, is subject to a penalty of $500 for each
violation.
Section 99. Effective date. This Act takes effect upon
becoming law.
