Bill Title: Amends the Illinois Municipal Code. Provides that no later than January 1, 2019, a municipal police department, including the police department of a home rule municipality, shall employ a full-time licensed clinical social worker or a licensed social worker. Provides that these requirements may be met by the police department of a municipality with a population of less than 20,000 through an intergovernmental agreement with one or more units of local government to jointly employ a full-time social worker. Amends the State Mandates Act to require implementation without reimbursement. Limits home rule powers. Effective immediately.

1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Illinois Municipal Code is amended by adding
5Section 11-1-10.5 as follows:
6 (65 ILCS 5/11-1-10.5 new)
7 Sec. 11-1-10.5. Social worker. No later than than January
81, 2019, a municipal police department, including the police
9department of a home rule municipality, shall employ a
10full-time licensed clinical social worker or a licensed social
11worker, as those terms are defined in Section 3 of the Clinical
12Social Work and Social Work Practice Act.
13 The requirements of this Section may be met by the police
14department of a municipality with a population of less than
1520,000 through an intergovernmental agreement with one or more
16units of local government to jointly employ a full-time
17licensed clinical social worker or a licensed social worker.
18 The requirement to hire a full-time social worker by a
19municipal police department is an exclusive power and function
20of the State. A home rule municipality may not regulate the
21requirement to hire a full-time social worker by a police
22department. This Section is a denial and limitation of home
23rule powers and functions under subsection (h) of Section 6 of

1Article VII of the Illinois Constitution.
2 Section 90. The State Mandates Act is amended by adding
3Section 8.42 as follows:
4 (30 ILCS 805/8.42 new)
5 Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8
6of this Act, no reimbursement by the State is required for the
7implementation of any mandate created by this amendatory Act of
8the 100th General Assembly.
9 Section 99. Effective date. This Act takes effect upon
10becoming law.
