Bill Title: Amends the Illinois Municipal Code. Provides that no later than January 1, 2019, a municipal police department, including the police department of a home rule municipality, shall employ a full-time licensed clinical social worker or a licensed social worker. Provides that these requirements may be met by the police department of a municipality with a population of less than 20,000 through an intergovernmental agreement with one or more units of local government to jointly employ a full-time social worker. Amends the State Mandates Act to require implementation without reimbursement. Limits home rule powers. Effective immediately.

AN ACT concerning local government.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Illinois Municipal Code is amended by adding
Section 11-1-10.5 as follows:
(65 ILCS 5/11-1-10.5 new)
Sec. 11-1-10.5. Social worker. No later than than January
1, 2019, a municipal police department, including the police
department of a home rule municipality, shall employ a
full-time licensed clinical social worker or a licensed social
worker, as those terms are defined in Section 3 of the Clinical
Social Work and Social Work Practice Act.
The requirements of this Section may be met by the police
department of a municipality with a population of less than
20,000 through an intergovernmental agreement with one or more
units of local government to jointly employ a full-time
licensed clinical social worker or a licensed social worker.
The requirement to hire a full-time social worker by a
municipal police department is an exclusive power and function
of the State. A home rule municipality may not regulate the
requirement to hire a full-time social worker by a police
department. This Section is a denial and limitation of home
rule powers and functions under subsection (h) of Section 6 of

Article VII of the Illinois Constitution.
Section 90. The State Mandates Act is amended by adding
Section 8.42 as follows:
(30 ILCS 805/8.42 new)
Sec. 8.42. Exempt mandate. Notwithstanding Sections 6 and 8
of this Act, no reimbursement by the State is required for the
implementation of any mandate created by this amendatory Act of
the 100th General Assembly.
Section 99. Effective date. This Act takes effect upon
becoming law.
