1 | AN ACT concerning local government.
| ||||||
2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Counties Code is amended by adding Section | ||||||
5 | 5-1131 as follows:
| ||||||
6 | (55 ILCS 5/5-1131 new) | ||||||
7 | Sec. 5-1131. Americans with Disabilities Act coordinator; | ||||||
8 | posting and publication. | ||||||
9 | (a) Within 90 days after the effective date of this | ||||||
10 | amendatory Act of the 96th General Assembly, each county that | ||||||
11 | maintains a website must post on the county's website the | ||||||
12 | following information: | ||||||
13 | (1) the name, office address, and telephone number of | ||||||
14 | the Americans with Disabilities Act coordinator, if any, | ||||||
15 | employed by the county; and | ||||||
16 | (2) the grievance procedures, if any, adopted by the | ||||||
17 | county to resolve complaints alleging a violation of Title | ||||||
18 | II of the Americans with Disabilities Act. | ||||||
19 | (b) If a county does not maintain a website, then the | ||||||
20 | county must, within 90 days after the effective date of this | ||||||
21 | amendatory Act of the 96th General Assembly, and at least once | ||||||
22 | every other year thereafter, publish in either a newspaper of | ||||||
23 | general circulation within the county or a newsletter published |

1 | by the county and mailed to county residents the information | ||||||
2 | required in item (1) of subsection (a) and either the | ||||||
3 | information required in item (2) of subsection (a) or | ||||||
4 | instructions for obtaining such information from the county. | ||||||
5 | (c) No home rule county may adopt posting or publication | ||||||
6 | requirements that are less restrictive than this Section. This | ||||||
7 | Section is a limitation under subsection (i) of Section 6 of | ||||||
8 | Article VII of the Illinois Constitution on the concurrent | ||||||
9 | exercise by home rule units of powers and functions exercised | ||||||
10 | by the State.

11 | Section 10. The Township Code is amended by adding Section | ||||||
12 | 85-60 as follows:

13 | (60 ILCS 1/85-60 new) | ||||||
14 | Sec. 85-60. Americans with Disabilities Act coordinator; | ||||||
15 | posting and publication. | ||||||
16 | (a) Within 90 days after the effective date of this | ||||||
17 | amendatory Act of the 96th General Assembly, each township that | ||||||
18 | maintains a website must post on the township's website the | ||||||
19 | following information: | ||||||
20 | (1) the name, office address, and telephone number of | ||||||
21 | the Americans with Disabilities Act coordinator, if any, | ||||||
22 | employed by the township; and | ||||||
23 | (2) the grievance procedures, if any, adopted by the | ||||||

16 | (a) Within 90 days after the effective date of this | ||||||
17 | amendatory Act of the 96th General Assembly, each municipality | ||||||
18 | that maintains a website must post on the municipality's | ||||||
19 | website the following information: | ||||||

18 | Section 90. The State Mandates Act is amended by adding | ||||||
19 | Section 8.33 as follows:

20 | (30 ILCS 805/8.33 new) | ||||||
21 | Sec. 8.33. Exempt mandate. Notwithstanding Sections 6 and 8 | ||||||
22 | of this Act, no reimbursement by the State is required for the | ||||||
23 | implementation of any mandate created by this amendatory Act of | ||||||
