3 | with reference to page and line numbers of Senate Amendment No. | ||||||
4 | 1, on page 1, lines 4 and 5, by replacing "Section 27A-5.5" | ||||||
5 | with "Sections 27A-5.5 and 27A-5.10"; and

6 | on page 1, immediately below line 9, by inserting the | ||||||
7 | following:

8 | "(105 ILCS 5/27A-5.10 new) | ||||||
9 | Sec. 27A-5.10. Waiver of fees. | ||||||
10 | (a) The governing body of a charter school shall waive all | ||||||
11 | fees assessed by the charter school
on children whose parents | ||||||
12 | are unable to afford them, including, but not limited
to, | ||||||
13 | children living in households that meet the free lunch or | ||||||
14 | breakfast eligibility guidelines established by the federal | ||||||
15 | government pursuant to Section 1758 of the federal Richard B. | ||||||
16 | Russell National School Lunch Act (42 U.S.C. 1758; 7 C.F.R. 245 |

1 | et seq.), subject to verification as set forth in subsection | ||||||
2 | (b) of this Section. The governing body of the charter school | ||||||
3 | shall develop written
policies and procedures implementing | ||||||
4 | this Section in accordance with
rules adopted by the State | ||||||
5 | Board of Education. | ||||||
6 | (b) If the governing body of a charter school participates | ||||||
7 | in a federally funded, school-based, child nutrition program | ||||||
8 | and uses a student's application for, eligibility for, or | ||||||
9 | participation in the federally funded, school-based, child | ||||||
10 | nutrition program (42 U.S.C. 1758; 7 C.F.R. 245 et seq.) as the | ||||||
11 | basis for waiving fees assessed by the charter school, then the | ||||||
12 | governing body of the charter school must follow the | ||||||
13 | verification requirements of the federally funded, | ||||||
14 | school-based, child nutrition program (42 U.S.C. 1758; 7 C.F.R. | ||||||
15 | 245.6a). | ||||||
16 | If the governing body of a charter school establishes a | ||||||
17 | process for the determination of eligibility for waiver of fees | ||||||
18 | assessed by the charter school that is completely independent | ||||||
19 | of a student's application for, eligibility for, or | ||||||
20 | participation in a federally funded, school-based, child | ||||||
21 | nutrition program, then the governing body of the charter | ||||||
22 | school may provide for fee waiver verification no more often | ||||||
23 | than every 60 calendar days. Information obtained during the | ||||||
24 | independent, fee waiver verification process indicating that | ||||||
25 | the student does not meet free lunch or breakfast eligibility | ||||||
26 | guidelines may be used to deny the waiver of the student's |

1 | fees, provided that any information obtained through this | ||||||
2 | independent process for determining or verifying eligibility | ||||||
3 | for fee waivers shall not be used to determine or verify | ||||||
4 | eligibility for any federally funded, school-based, child | ||||||
5 | nutrition program. ".
