1 | AN ACT concerning housing.
| |||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:
| |||||||||||||||||||
4 | Section 5. The Housing Authorities Act is amended by | |||||||||||||||||||
5 | changing Section 8.1c as follows:
| |||||||||||||||||||

| |||||||||||||||||||
7 | Sec. 8.1c. Citizens Review Board. A Citizens Review Board | |||||||||||||||||||
8 | is
established for the
the housing authority in any
| |||||||||||||||||||
9 | municipality having over 500,000 inhabitants to
monitor the
| |||||||||||||||||||
10 | housing authority police force. | |||||||||||||||||||
11 | The Board shall consist of 9 members with 5 appointed by | |||||||||||||||||||
12 | the executive
director
of the housing authority, 2 appointed by | |||||||||||||||||||
13 | the housing authority's Central
Advisory Council, and 2 | |||||||||||||||||||
14 | appointed by the housing authority's Senior Advisory
Council. | |||||||||||||||||||
15 | The initial terms of the members shall be one, 2, 3, 4, and 5 | |||||||||||||||||||
16 | years
for the members appointed by the executive director, one | |||||||||||||||||||
17 | and 2 years for the
members appointed by the Central Advisory | |||||||||||||||||||
18 | Council, and one and 2 years for the
members appointed by the | |||||||||||||||||||
19 | Senior Advisory Council. The
appointing authority shall | |||||||||||||||||||
20 | determine which initial term each appointee shall
serve.
Each | |||||||||||||||||||
21 | successor of the initial members shall serve for a term of 4 | |||||||||||||||||||
22 | years.
The initial appointments to the Board shall be made | |||||||||||||||||||
23 | within 30 days of the
effective date of this amendatory Act of |

1 | 1997.
The Board shall select one of its members to serve as | ||||||
2 | chairperson.
The Board may, after notice and a hearing, remove | ||||||
3 | by majority vote
a member of the Board who has been found | ||||||
4 | guilty of neglect of duty or
malfeasance. If a
member of the | ||||||
5 | Board resigns or is removed, the official or body that would
| ||||||
6 | appoint the
member's successor shall appoint a person to serve | ||||||
7 | the remainder of the
member's term. After a member's term | ||||||
8 | expires, the member shall continue to
serve until a successor | ||||||
9 | is appointed and qualified.
| ||||||
10 | Subject to collective bargaining agreements, the Board
has | ||||||
11 | the authority, after holding a
hearing, to
suspend, terminate, | ||||||
12 | or take other disciplinary action
against a
housing authority | ||||||
13 | police officer if:
| ||||||
14 | (1) the officer is found by the Board to have | ||||||
15 | physically
abused a tenant or his or her guest while the | ||||||
16 | officer was on
duty;
| ||||||
17 | (2) the officer is found by the Board to have entered | ||||||
18 | the residence of a
housing authority tenant and was neither | ||||||
19 | (i) executing a legally issued arrest
warrant or search | ||||||
20 | warrant for that residence nor (ii) otherwise lawfully
| ||||||
21 | present in the residence; or
| ||||||
22 | (3) the officer is found by the Board to have | ||||||
23 | physically
abused
a person on or off housing authority | ||||||
24 | property while performing his or her duty
as a housing | ||||||
25 | authority police officer.
