Bill Title: Creates the Law Enforcement Officer Body-worn Camera System Act. Provides that each law enforcement agency shall, no later than January 1, 2018, implement and operate a body-worn camera system with the model policy or guideline for that system established by the Department of State Police before July 1, 2017. Provides that nothing in the Act prohibits a police force that is not required to implement and operate a body-worn camera system under the Act from implementing and operating that system, provided that the system is implemented and operated in accordance with the model policy or guideline for the system established by the Department of State Police. Amends the Department of State Police Law of the Civil Administrative Code of Illinois to make conforming changes.

1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 1. Short title. This Act may be cited as the Law | ||||||||||||||||||||||||||
5 | Enforcement Officer Body-worn Camera System Act.

6 | Section 5. Definitions. In this Act: | ||||||||||||||||||||||||||
7 | "Body-worn camera system" means an electronic system for | ||||||||||||||||||||||||||
8 | creating, generating, sending, receiving, storing, displaying, | ||||||||||||||||||||||||||
9 | and processing audiovisual recordings, including cameras or | ||||||||||||||||||||||||||
10 | other devices capable of creating those recordings, that may be | ||||||||||||||||||||||||||
11 | worn about the person of a law enforcement officer. | ||||||||||||||||||||||||||
12 | "Law enforcement agency" means the Department of State | ||||||||||||||||||||||||||
13 | Police, county sheriff's office, or municipal police | ||||||||||||||||||||||||||
14 | department. | ||||||||||||||||||||||||||
15 | "Law enforcement officer" means a peace officer employed by | ||||||||||||||||||||||||||
16 | the Department of State Police, county sheriff, or municipal | ||||||||||||||||||||||||||
17 | police department who is assigned duties by the employing law | ||||||||||||||||||||||||||
18 | enforcement agency to maintain public order or to make arrests | ||||||||||||||||||||||||||
19 | for offenses or ordinance violations, but does not include a | ||||||||||||||||||||||||||
20 | detective, laboratory employee, public relations officer, | ||||||||||||||||||||||||||
21 | liaison, or agency attorney even if he or she meets the | ||||||||||||||||||||||||||
22 | definition of peace officer but in which his or her duties do | ||||||||||||||||||||||||||
23 | not primarily involve maintaining public order or making |

1 | arrests. | ||||||
2 | "Peace officer" has the meaning ascribed to it in Section | ||||||
3 | 2-13 of the Criminal Code of 2012.

4 | Section 10. Law enforcement officers; body-worn camera | ||||||
5 | system. | ||||||
6 | (a) Each law enforcement agency shall, no later than | ||||||
7 | January 1, 2018, implement and operate a body-worn camera | ||||||
8 | system with the model policy or guideline for that system | ||||||
9 | established by the Department of State Police. | ||||||
10 | (b) Nothing in this Act prohibits a police force that is | ||||||
11 | not required to implement and operate a body-worn camera system | ||||||
12 | under this Act from implementing and operating the system; | ||||||
13 | provided that the system is implemented and operated in | ||||||
14 | accordance with the model policy or guideline for the system | ||||||
15 | established by the Department of State Police.

16 | Section 105. The Department of State Police Law of the
| ||||||
17 | Civil Administrative Code of Illinois is amended by adding | ||||||
18 | Section 2605-605 as follows:

20 | Sec. 2605-605. Department of State Police; model policy or | ||||||
21 | guideline for body-worn camera system. | ||||||
22 | (a) In this Section, "body-worn camera system" and "law | ||||||
23 | enforcement officer" have the meanings ascribed to them in |

3 | (b) Before July 1, 2017, the Department of State Police, by | ||||||
4 | rule, shall establish a model policy or guideline for the | ||||||
5 | implementation and use of a body-worn camera system by law | ||||||
6 | enforcement officers.
