1 AN ACT concerning local government.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The Public Officer Prohibited Activities Act is
5amended by adding Section 5 as follows:
6 (50 ILCS 105/5 new)
7 Sec. 5. Ban on promotional materials.
8 (a) This Section applies to all units of local government,
9local officials, school districts, and public institutions of
10higher education, as that term is defined under Section 2 of
11the Higher Education Cooperation Act, which includes community
12colleges. This Section also applies to all employees of a unit
13of local government, a local official, school district, or
14public institution of higher education, and persons or
15contractors working on behalf of a unit of local government, a
16local official, school district, or public institution of
17higher education.
18 (b) No person or entity to which this Section applies shall
19use public moneys to send any promotional materials to
20residents, except those directly related to course offerings,
21programs of study, or certificate or degree programs, including
22information regarding tuition and expenses, during the
23following periods:

1 (1) For units of local government with offices elected
2 at the consolidated election, during a period beginning
3 January 1 through the day after the consolidated election.
4 (2) For all other units of local government, during a
5 period beginning February 1 of the year of a general
6 primary election and ending the day after the general
7 primary election and during a period beginning September 1
8 of the year of a general election and ending the day after
9 the general election.
10 (c) The restrictions imposed under this Section do not
11apply to bills, schedules of events, or course-related
12materials, including financial aid.
13 (d) Any person who violates this Section is subject to the
14penalties set forth in Section 4 of this Act, including
15termination of employment.
