Bill Title: Amends the Criminal Code of 1961. Creates the offense of obstructing identification. Provides that a person commits the offense when he or she intentionally or knowingly furnishes a false or fictitious name, residence address, or date of birth to a peace officer who has: (1) lawfully arrested the person; (2) lawfully detained the person; or (3) requested the information from a person that the peace officer has good cause to believe is a witness to a criminal offense. Provides that a violation is a Class A misdemeanor.

1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Criminal Code of 1961 is amended by adding | ||||||
5 | Section 31-4.5 as follows:

6 | (720 ILCS 5/31-4.5 new) | ||||||
7 | Sec. 31-4.5. Obstructing identification. | ||||||
8 | (a) A person commits the offense of obstructing | ||||||
9 | identification when he or she intentionally or knowingly | ||||||
10 | furnishes a false or fictitious name, residence address, or | ||||||
11 | date of birth to a peace officer who has: | ||||||
12 | (1) lawfully arrested the person; | ||||||
13 | (2) lawfully detained the person; or | ||||||
14 | (3) requested the information from a person that the | ||||||
15 | peace officer has good cause to believe is a witness to a | ||||||
16 | criminal offense. | ||||||
17 | (b) Sentence. Obstructing identification is a Class A | ||||||
18 | misdemeanor.
