Bill Title: Amends the Public Utilities Act. Provides for a waste-to-energy electric generation program. Requires every investor-owned public utility to file with the Illinois Commerce Commission a standard tariff for electricity purchased from an electric generation facility. Provides that the Commission may limit the projects to 2 standard tariffs per territory in Illinois. Provides requirements for the use of the applicable tariffs, and accompanying costs. AN ACT concerning regulation.
Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Public Utilities Act is amended by adding
Section 16-115E as follows:
(220 ILCS 5/16-115E new)
Sec. 16-115E. Waste-to-energy electric generation.
(a) As used in this Section, "electric generation facility"
means an electric generation facility located within the
service territory of, and developed to sell electricity to, an
investor-owned public utility that:
(1) has an effective capacity of not more than 3
megawatts;
(2) is interconnected and operates in parallel with the
electrical transmission and distribution grid;
(3) is strategically located and interconnected to the
electrical transmission and distribution grid in a manner
that optimizes the deliverability of electricity generated
at the facility to load centers; and
(4) is an eligible renewable energy resource.
(b) It is the policy of the State of Illinois and the
intent of the General Assembly to encourage electrical
generation from eligible renewable energy resources. To that

end, the purpose of this Section is to allow wastewater plants
to build turbines to power electricity from their waste fuel in
order to produce another viable form of electrical generation
for this State.
(c) Every investor-owned public utility shall file with the
Commission a standard tariff for electricity purchased from an
electric generation facility. The Commission may limit the
projects to 2 standard tariffs per territory in Illinois. Each
tariff shall provide for payment for every kilowatthour of
electricity purchased from an electric generation facility for
a period of 10, 15, or 20 years, as authorized by the
Commission. The payment shall be the market price determined by
the Commission, using a methodology developed by the
Commission, and shall include all current and anticipated
environmental compliance costs, including, but not limited to,
mitigation of emissions of greenhouse gases and air pollution
offsets associated with the operation of new generating
facilities. The tariffs shall be completed within 12 months
after the effective date of this amendatory Act of the 100th
General Assembly.
(d) The Commission shall adopt any rules necessary to
implement the program created under this Section.
Section 99. Effective date. This Act takes effect upon
becoming law.
