Bill Title: Creates the K-12 Educational MRSA Prevention Act. Provides that by no later than 90 days after implementation of guidelines and specifications established by the Illinois MRSA Coordinating Council for methicillin resistant Staphylococcus aureus (MRSA) prevention and maintenance procedures in school facilities, provides that all Kindergarten through grade 12 elementary and secondary public and non-public schools in this State shall establish and implement a MRSA prevention policy and exclusively purchase and use disinfecting products approved by the federal Environmental Protection Agency and registered with the Illinois Department of Agriculture and bearing efficacy claims listed on the label pursuant to the guidelines and specifications. Sets forth provisions concerning the establishment, annual amendment, and dissemination of the guidelines and specifications. Effective immediately.

SYNOPSIS AS INTRODUCED:
New Act
30 ILCS 805/8.33 new

Creates the K-12 Educational MRSA Prevention Act. 1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 1. Short title. This Act may be cited as the K-12
5 Educational MRSA Prevention Act.
6 Section 5. Legislative findings. The General Assembly
7 finds that children are vulnerable to and may be severely
8 affected by exposure to methicillin resistant Staphylococcus
9 aureus (MRSA). The Centers for Disease Control and Prevention
10 (CDC) estimates that the number of MRSA related deaths in 2006
11 exceeds the number of HIV related deaths. The CDC also
12 estimates that 1 in 4 people are carriers and potential
13 transmitters of MRSA. Children, teachers, janitors, and other
14 staff members spend a significant amount of time inside school
15 buildings in close contact and are continuously exposed to
16 potential risk.
17 Section 10. Definitions. In this Act:
18 "IMCC" means the Illinois MRSA Coordinating Council.
19 "MRSA" means methicillin resistant Staphylococcus aureus.
20 Section 15. Use of disinfecting products. By no later than
21 90 days after implementation of the guidelines and

1 specifications established under Section 20 of this Act, all
2 Kindergarten through grade 12 elementary and secondary public
3 and non-public schools in this State shall establish and
4 implement a MRSA prevention policy and exclusively purchase and
5 use disinfecting products approved by the federal
6 Environmental Protection Agency and registered with the
7 Illinois Department of Agriculture and bearing efficacy claims
8 listed on the label pursuant to the guidelines and
9 specifications established under Section 20 this Act.
10 Section 20. MRSA guidelines and specifications. The
11 Illinois MRSA Coordinating Council shall, in consultation with
12 at a minimum the Department of Public Health, the State Board
13 of Education, regional offices of education, and the Illinois
14 Environmental Protection Agency, establish and amend on an
15 annual basis guidelines and specifications for MRSA prevention
16 and maintenance procedures in school facilities. Guidelines
17 and specifications must be established after a review and
18 evaluation of existing research and must be completed no later
19 than 180 days after the effective date of this Act. Guidelines
20 and specifications may include implementation practices,
21 including inspection. The completed guidelines and
22 specifications must be posted on the IMCC's Internet website.
23 Section 25. Dissemination to schools.
24 (a) Upon the completion of the guidelines and

1 specifications under Section 20 of this Act, the IMCC shall
2 provide each regional office of education, each non-public
3 school in this State, and the Chicago Department of Environment
4 with the guidelines and specifications. Each regional office of
5 education shall immediately disseminate the guidelines and
6 specifications to every public school in the educational
7 service region. Regional offices of education, the Chicago
8 Department of Environment, and the IMCC shall provide on-going
9 assistance to schools to carry out the requirements of this
10 Act.
11 (b) In the event that the guidelines and specifications
12 under Section 20 of this Act are updated by the IMCC, the IMCC
13 shall provide the updates to each regional office of education
14 for immediate dissemination to each public school.
15 Additionally, the IMCC shall post all updated materials on its
16 Internet website.
17 Section 90. The State Mandates Act is amended by adding
18 Section 8.33 as follows:
19 (30 ILCS 805/8.33 new)
20 Sec. 8.33. Exempt mandate. Notwithstanding Sections 6 and 8
21 of this Act, no reimbursement by the State is required for the
22 implementation of any mandate created by the K-12 Educational
23 MRSA Prevention Act.
24 Section 99. Effective date. This Act takes effect upon
