1 | AN ACT concerning civil law.
| ||||||
2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Mobile Home Landlord and Tenant Rights Act | ||||||
5 | is amended by adding Section 8.6 as follows:
| ||||||
6 | (765 ILCS 745/8.6 new) | ||||||
7 | Sec. 8.6. Mobile and Manufactured Home Relocation | ||||||
8 | Commission. | ||||||
9 | (a) There is created a Mobile and Manufactured Home | ||||||
10 | Relocation Commission. The purpose of the Commission is to | ||||||
11 | study the process and procedure by which a mobile or | ||||||
12 | manufactured home located in a mobile or manufactured home park | ||||||
13 | that is closing is relocated. The Department of Public Health | ||||||
14 | shall provide administrative support to the Commission. | ||||||
15 | (b) The Commission shall consist of the following 10 | ||||||
16 | members: | ||||||
17 | (1) the Director of the Department of Public Health or | ||||||
18 | his or her designee; | ||||||
19 | (2) the Attorney General of the State of Illinois or | ||||||
20 | his or her designee; | ||||||
21 | (3) four members of the General Assembly, with the | ||||||
22 | Speaker of the House, the Senate President, the House | ||||||
23 | Minority Leader, and the Senate Minority Leader each making |

1 | one appointment; | ||||||
2 | (4) the President of an organization primarily | ||||||
3 | representing the interests of park owners having | ||||||
4 | properties in downstate Illinois and mobile and | ||||||
5 | manufactured home retailers or his or her designee, | ||||||
6 | appointed by the Governor; | ||||||
7 | (5) the Executive Director of an organization | ||||||
8 | primarily representing the interests of park owners having | ||||||
9 | properties in northern Illinois or his or her designee, | ||||||
10 | appointed by the Governor; and | ||||||
11 | (6) two representatives of a statewide organization | ||||||
12 | representing the interests of mobile and manufactured home | ||||||
13 | owners, appointed by the Governor. | ||||||
14 | (c) The members appointed by the Speaker of the House and | ||||||
15 | the Senate Minority Leader shall serve as Co-Chairs of the | ||||||
16 | Commission. | ||||||
17 | (d) The Commission shall: | ||||||
18 | (1) examine the implementation and operation of | ||||||
19 | relocation assistance programs in other states; | ||||||
20 | (2) consider possible ways to fund State or local | ||||||
21 | relocation assistance programs, including but not limited | ||||||
22 | to home owner fees, park owner fees, and moving company | ||||||
23 | fees; | ||||||
24 | (3) examine the feasibility of allowing or mandating | ||||||
25 | park owners to create relocation trust funds; | ||||||
26 | (4) examine the feasibility of allowing or mandating a |

1 | State agency to create a relocation trust fund; | ||||||
2 | (5) explore the potential for greater oversight of park | ||||||
3 | practices; | ||||||
4 | (6) formulate a set of best practices to minimize the | ||||||
5 | impact of park closures on both park owners and home | ||||||
6 | owners; | ||||||
7 | (7) analyze data and other information with respect to | ||||||
8 | relocation; | ||||||
9 | (8) research the availability of insurance policies | ||||||
10 | that cover the costs of relocation; and | ||||||
11 | (9) study the costs and associated legal matters | ||||||
12 | arising from the abandonment of a home in a park. | ||||||
13 | (e) The Commission shall report to the General Assembly on | ||||||
14 | its results and progress on or before January 1, 2010. | ||||||
15 | (f) This Section is repealed on March 1, 2010.

16 | Section 99. Effective date. This Act takes effect upon | ||||||
17 | becoming law.
