Bill Title: Amends the Department of Professional Regulation Law of the Civil Administrative Code of Illinois. Defines "health care professional" as a person licensed or registered by the Department of Financial and Professional Regulation under the Medical Practice Act of 1987, Nurse Practice Act, Physician Assistant Practice Act of 1987, and Respiratory Care Practice Act or a person licensed or registered by the Department of Public Health under the Emergency Medical Services (EMS) Systems Act. Provides that, for license or registration renewals occurring on or after January 1, 2026, a health care professional who has continuing education requirements shall complete at least a one-hour course in training on the recognition and reporting of human trafficking. Provides rulemaking abilities for the Department of Financial and Professional Regulation. Amends the Trafficking Victims Protection Act. Provides that any person, institution, or agency participating in the making of a report, providing information or records related to a report, assessment, or services, or participating in the investigation of a report under the Act in good faith, or taking photographs or x-rays as a result of an authorized assessment, shall have immunity from any civil, criminal or other liability in any civil, criminal or other proceeding brought in consequence of making such report or assessment or on account of submitting or otherwise disclosing such photographs or x-rays to any agency designated to receive reports of alleged or suspected human trafficking. Provides that any person, institution, or agency authorized by the Department to provide assessment, intervention, or administrative services under the Act shall, in the good faith performance of those services, have immunity from any civil, criminal or other liability in any civil, criminal, or other proceeding brought as a consequence of the performance of those services. Provides that, for the purposes of any civil, criminal, or other proceeding, the good faith of any person required to report, permitted to report, or participating in an investigation of a report of alleged or suspected human trafficking shall be presumed.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Department of Professional Regulation Law | |||||||||||||||||||||
5 | of the Civil Administrative Code of Illinois is amended by | |||||||||||||||||||||
6 | adding Section 2105-15.8 as follows:

7 | (20 ILCS 2105/2105-15.8 new) | |||||||||||||||||||||
8 | Sec. 2105-15.8. Continuing education; human trafficking | |||||||||||||||||||||
9 | training. | |||||||||||||||||||||
10 | (a) As used in this Section, "health care professional" | |||||||||||||||||||||
11 | means the following: | |||||||||||||||||||||
12 | (1) a person licensed or registered by the Department | |||||||||||||||||||||
13 | of Financial and Professional Regulation under the Medical | |||||||||||||||||||||
14 | Practice Act of 1987, Nurse Practice Act, Physician | |||||||||||||||||||||
15 | Assistant Practice Act of 1987, and Respiratory Care | |||||||||||||||||||||
16 | Practice Act; or | |||||||||||||||||||||
17 | (2) a person licensed or registered by the Department | |||||||||||||||||||||
18 | of Public Health under the Emergency Medical Services | |||||||||||||||||||||
19 | (EMS) Systems Act. | |||||||||||||||||||||
20 | (a) For license or registration renewals occurring on or | |||||||||||||||||||||
21 | after January 1, 2026, a health care professional who has | |||||||||||||||||||||
22 | continuing education requirements shall complete at least a | |||||||||||||||||||||
23 | one-hour course in training on the recognition and reporting |

2 | this one hour for completion of this course toward meeting the | ||||||
3 | minimum credit hours required for continuing education. Any | ||||||
4 | training on human trafficking applied to meet any other State | ||||||
5 | licensure requirement, professional accreditation or | ||||||
6 | certification requirement, or health care institutional | ||||||
7 | practice agreement may count toward the continuing education | ||||||
8 | requirement under this Section. | ||||||
9 | (b) The Department may adopt rules for the implementation | ||||||
10 | of this Section.
