Bill Title: Amends the School Code. Provides that a school district must employ a sufficient number of school nurses to address the needs of the school district's students, but no less than a student-to-nurse ratio of 750 to 1. Provides that consideration for school nurse staffing should include the complex health needs of students, needs for continuous professional nursing services, the number of free and reduced lunch students in a school building, and the average number of medical emergencies at a school per year. Provides that a school district must employ a sufficient number of school psychologists to address the needs of the school district's students and schools, but no less than a student-to-social worker ratio of 500 to 1. Effective June 30, 2023.

1 | AN ACT concerning education.
| ||||||||||||||||||||||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The School Code is amended by changing Sections | ||||||||||||||||||||||||||
5 | 10-22.23 and 14-1.09 as follows:

6 | (105 ILCS 5/10-22.23) (from Ch. 122, par. 10-22.23)
| ||||||||||||||||||||||||||
7 | Sec. 10-22.23. School Nurse. To employ a registered | ||||||||||||||||||||||||||
8 | professional
nurse and define the duties of the school nurse | ||||||||||||||||||||||||||
9 | within the guidelines of
rules and regulations promulgated by | ||||||||||||||||||||||||||
10 | the State Board of Education. Any
school nurse first employed | ||||||||||||||||||||||||||
11 | on or after July 1, 1976, whose duties
require teaching or the | ||||||||||||||||||||||||||
12 | exercise of instructional judgment or educational
evaluation | ||||||||||||||||||||||||||
13 | of pupils, must be licensed under Section 21B-25 of this Code.

14 | School districts may employ nonlicensed registered | ||||||||||||||||||||||||||
15 | professional nurses
to perform professional nursing services. | ||||||||||||||||||||||||||
16 | A school district must employ a sufficient number of | ||||||||||||||||||||||||||
17 | school nurses to address the needs of their students, but no | ||||||||||||||||||||||||||
18 | less than a student-to-nurse ratio of 750 to 1. Consideration | ||||||||||||||||||||||||||
19 | for school nurse staffing should include the complex health | ||||||||||||||||||||||||||
20 | needs of students, needs for continuous professional nursing | ||||||||||||||||||||||||||

3 | Sec. 14-1.09. School psychologist. "School psychologist" | ||||||
4 | means a
psychologist who meets the following qualifications: | ||||||
5 | (1) The psychologist: | ||||||
6 | (A) has graduated with a master's or higher degree | ||||||
7 | in
psychology or educational psychology from an | ||||||
8 | institution of higher learning that
maintains | ||||||
9 | equipment,
courses of study, and standards of | ||||||
10 | scholarship approved by the State Board
of Education, | ||||||
11 | has had at least one school year of full-time | ||||||
12 | supervised
experience in the delivery of school | ||||||
13 | psychological services of a character
approved by the | ||||||
14 | State
Superintendent of Education, and has such | ||||||
15 | additional qualifications
as may be required
by the | ||||||
16 | State Board of Education; or | ||||||
17 | (B) holds a valid Nationally Certified School | ||||||
18 | Psychologist (NCSP) credential. | ||||||
19 | (2) The psychologist holds a Professional Educator | ||||||
20 | License with a school psychologist endorsement issued | ||||||
21 | pursuant to Section 21B-25 of this Code.
Persons so | ||||||
22 | licensed may use the title "school psychologist" and may
| ||||||
23 | offer school psychological services which are limited to | ||||||
24 | those services set
forth in 23 Ill. Adm. Code 226, Special | ||||||
25 | Education, pertaining to children
between the ages of 3 to |
| |||||||
| |||||||
1 | 21, promulgated by the State Board of Education.
| ||||||
2 | School psychologists may make evaluations, recommendations | ||||||
3 | or interventions
regarding the placement of children in | ||||||
4 | educational programs or special
education classes. However, a | ||||||
5 | school psychologist shall not provide such
services outside | ||||||
6 | his or her employment to any student in the district or
| ||||||
7 | districts which employ such school psychologist. | ||||||
8 | A school district must employ a sufficient number of | ||||||
9 | school psychologists to address the needs of the school | ||||||
10 | district's students and schools, but no less than a | ||||||
11 | student-to-social worker ratio of 500 to 1.

13 | Section 99. Effective date. This Act takes effect June 30, | ||||||
14 | 2023.
