Bill Title: Amends the Election Code. Provides that an applicant for voter registration shall provide a valid and unexpired driver's license; social security card; public aid identification card; utility bill; lease or contract for a residence; civic, union, or professional association membership card; United States passport; or any other form of identification or documentation issued by the federal, State, or unit of local government that contains the applicant's residential address. Provides that the affidavits required for voter registration include additional affirmations concerning the residency of the applicant.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Election Code is amended by changing | |||||||||||||||||||||||||||||||
5 | Sections 4-8, 4-10, 5-7, 5-9, 6-29, 6-35, and 6-37 as follows:

7 | Sec. 4-8. The county clerk shall provide a sufficient | |||||||||||||||||||||||||||||||
8 | number of blank forms for the registration of electors, which | |||||||||||||||||||||||||||||||
9 | shall be known as registration record cards and which shall | |||||||||||||||||||||||||||||||
10 | consist of loose leaf sheets or cards, of suitable size to | |||||||||||||||||||||||||||||||
11 | contain in plain writing and figures the data hereinafter | |||||||||||||||||||||||||||||||
12 | required thereon or shall consist of computer cards of | |||||||||||||||||||||||||||||||
13 | suitable nature to contain the data required thereon. The | |||||||||||||||||||||||||||||||
14 | registration record cards, which shall include an affidavit of | |||||||||||||||||||||||||||||||
15 | registration as hereinafter provided, shall be executed in | |||||||||||||||||||||||||||||||
16 | duplicate. | |||||||||||||||||||||||||||||||
17 | The registration record card shall contain the following | |||||||||||||||||||||||||||||||
18 | and such other information as the county clerk may think it | |||||||||||||||||||||||||||||||
19 | proper to require for the identification of the applicant for | |||||||||||||||||||||||||||||||
20 | registration: | |||||||||||||||||||||||||||||||
21 | Name. The name of the applicant, giving surname and first | |||||||||||||||||||||||||||||||
22 | or Christian name in full, and the middle name or the initial | |||||||||||||||||||||||||||||||
23 | for such middle name, if any. |

1 | Sex. | ||||||
2 | Residence. The name and number of the street, avenue, or | ||||||
3 | other location of the dwelling, including the apartment, unit | ||||||
4 | or room number, if any, and in the case of a mobile home the | ||||||
5 | lot number, and such additional clear and definite description | ||||||
6 | as may be necessary to determine the exact location of the | ||||||
7 | dwelling of the applicant. Where the location cannot be | ||||||
8 | determined by street and number, then the section, | ||||||
9 | congressional township and range number may be used, or such | ||||||
10 | other description as may be necessary, including post-office | ||||||
11 | mailing address. In the case of a homeless individual, the | ||||||
12 | individual's voting residence that is his or her mailing | ||||||
13 | address shall be included on his or her registration record | ||||||
14 | card. | ||||||
15 | Term of residence in the State of Illinois and precinct. | ||||||
16 | This information shall be furnished by the applicant stating | ||||||
17 | the place or places where he resided and the dates during which | ||||||
18 | he resided in such place or places during the year next | ||||||
19 | preceding the date of the next ensuing election. | ||||||
20 | Nativity. The state or country in which the applicant was | ||||||
21 | born. | ||||||
22 | Citizenship. Whether the applicant is native born or | ||||||
23 | naturalized. If naturalized, the court, place, and date of | ||||||
24 | naturalization. | ||||||
25 | Date of application for registration, i.e., the day, month | ||||||
26 | and year when applicant presented himself for registration. |

1 | Age. Date of birth, by month, day and year. | ||||||
2 | Physical disability of the applicant, if any, at the time | ||||||
3 | of registration, which would require assistance in voting. | ||||||
4 | The county and state in which the applicant was last | ||||||

6 | Electronic mail address, if any. | ||||||
7 | Signature of voter. The applicant, after the registration | ||||||
8 | and in the presence of a deputy registrar or other officer of | ||||||
9 | registration shall be required to sign his or her name in ink | ||||||
10 | or digitized form to the affidavit on both the original and | ||||||
11 | duplicate registration record cards. | ||||||
12 | Signature of deputy registrar or officer of registration. | ||||||
13 | In case applicant is unable to sign his name, he may affix | ||||||
14 | his mark to the affidavit. In such case the officer empowered | ||||||
15 | to give the registration oath shall write a detailed | ||||||
16 | description of the applicant in the space provided on the back | ||||||
17 | or at the bottom of the card or sheet; and shall ask the | ||||||
18 | following questions and record the answers thereto: | ||||||
19 | Father's first name. | ||||||
20 | Mother's first name. | ||||||
21 | From what address did the applicant last register? | ||||||
22 | Reason for inability to sign name. | ||||||
23 | Each applicant for registration shall make an affidavit in | ||||||
24 | substantially the following form: | ||||||

18 | Space shall be provided upon the face of each registration | ||||||
19 | record card for the notation of the voting record of the person | ||||||
20 | registered thereon. | ||||||
21 | Each registration record card shall be numbered according | ||||||
22 | to precincts, and may be serially or otherwise marked for | ||||||
23 | identification in such manner as the county clerk may | ||||||
24 | determine. | ||||||
25 | The registration cards shall be deemed public records and |

1 | shall be open to inspection during regular business hours, | ||||||
2 | except during the 27 days immediately preceding any election. | ||||||
3 | On written request of any candidate or objector or any person | ||||||
4 | intending to object to a petition, the election authority | ||||||
5 | shall extend its hours for inspection of registration cards | ||||||
6 | and other records of the election authority during the period | ||||||
7 | beginning with the filing of petitions under Sections 7-10, | ||||||
8 | 8-8, 10-6 or 28-3 and continuing through the termination of | ||||||
9 | electoral board hearings on any objections to petitions | ||||||
10 | containing signatures of registered voters in the jurisdiction | ||||||
11 | of the election authority. The extension shall be for a period | ||||||
12 | of hours sufficient to allow adequate opportunity for | ||||||
13 | examination of the records but the election authority is not | ||||||
14 | required to extend its hours beyond the period beginning at | ||||||
15 | its normal opening for business and ending at midnight. If the | ||||||
16 | business hours are so extended, the election authority shall | ||||||
17 | post a public notice of such extended hours. Registration | ||||||
18 | record cards may also be inspected, upon approval of the | ||||||
19 | officer in charge of the cards, during the 27 days immediately | ||||||
20 | preceding any election. Registration record cards shall also | ||||||
21 | be open to inspection by certified judges and poll watchers | ||||||
22 | and challengers at the polling place on election day, but only | ||||||
23 | to the extent necessary to determine the question of the right | ||||||
24 | of a person to vote or to serve as a judge of election. At no | ||||||
25 | time shall poll watchers or challengers be allowed to | ||||||
26 | physically handle the registration record cards. |

1 | Updated copies of computer tapes or computer discs or | ||||||
2 | other electronic data processing information containing voter | ||||||
3 | registration information shall be furnished by the county | ||||||
4 | clerk within 10 days after December 15 and May 15 each year and | ||||||
5 | within 10 days after each registration period is closed to the | ||||||
6 | State Board of Elections in a form prescribed by the Board. For | ||||||
7 | the purposes of this Section, a registration period is closed | ||||||
8 | 27 days before the date of any regular or special election. | ||||||
9 | Registration information shall include, but not be limited to, | ||||||
10 | the following information: name, sex, residence, telephone | ||||||
11 | number, if any, age, party affiliation, if applicable, | ||||||
12 | precinct, ward, township, county, and representative, | ||||||
13 | legislative and congressional districts. In the event of | ||||||
14 | noncompliance, the State Board of Elections is directed to | ||||||
15 | obtain compliance forthwith with this nondiscretionary duty of | ||||||
16 | the election authority by instituting legal proceedings in the | ||||||
17 | circuit court of the county in which the election authority | ||||||
18 | maintains the registration information. The costs of | ||||||
19 | furnishing updated copies of tapes or discs shall be paid at a | ||||||
20 | rate of $.00034 per name of registered voters in the election | ||||||
21 | jurisdiction, but not less than $50 per tape or disc and shall | ||||||
22 | be paid from appropriations made to the State Board of | ||||||
23 | Elections for reimbursement to the election authority for such | ||||||
24 | purpose. The State Board shall furnish copies of such tapes, | ||||||
25 | discs, other electronic data or compilations thereof to state | ||||||
26 | political committees registered pursuant to the Illinois |

1 | Campaign Finance Act or the Federal Election Campaign Act and | ||||||
2 | to governmental entities, at their request and at a reasonable | ||||||
3 | cost. To protect the privacy and confidentiality of voter | ||||||
4 | registration information, the disclosure of electronic voter | ||||||
5 | registration records to any person or entity other than to a | ||||||
6 | State or local political committee and other than to a | ||||||
7 | governmental entity for a governmental purpose is specifically | ||||||
8 | prohibited except as follows: subject to security measures | ||||||
9 | adopted by the State Board of Elections which, at a minimum, | ||||||
10 | shall include the keeping of a catalog or database, available | ||||||
11 | for public view, including the name, address, and telephone | ||||||
12 | number of the person viewing the list as well as the time of | ||||||
13 | that viewing, any person may view the centralized statewide | ||||||
14 | voter registration list on a computer screen at the | ||||||
15 | Springfield office of the State Board of Elections, during | ||||||
16 | normal business hours other than during the 27 days before an | ||||||
17 | election, but the person viewing the list under this exception | ||||||
18 | may not print, duplicate, transmit, or alter the list. Copies | ||||||
19 | of the tapes, discs, or other electronic data shall be | ||||||
20 | furnished by the county clerk to local political committees | ||||||
21 | and governmental entities at their request and at a reasonable | ||||||
22 | cost. Reasonable cost of the tapes, discs, et cetera for this | ||||||
23 | purpose would be the cost of duplication plus 15% for | ||||||
24 | administration. The individual representing a political | ||||||
25 | committee requesting copies of such tapes shall make a sworn | ||||||
26 | affidavit that the information shall be used only for bona |

1 | fide political purposes, including by or for candidates for | ||||||
2 | office or incumbent office holders. Such tapes, discs or other | ||||||
3 | electronic data shall not be used under any circumstances by | ||||||
4 | any political committee or individuals for purposes of | ||||||
5 | commercial solicitation or other business purposes. If such | ||||||
6 | tapes contain information on county residents related to the | ||||||
7 | operations of county government in addition to registration | ||||||
8 | information, that information shall not be used under any | ||||||
9 | circumstances for commercial solicitation or other business | ||||||
10 | purposes. The prohibition in this Section against using the | ||||||
11 | computer tapes or computer discs or other electronic data | ||||||
12 | processing information containing voter registration | ||||||
13 | information for purposes of commercial solicitation or other | ||||||
14 | business purposes shall be prospective only from the effective | ||||||
15 | date of this amended Act of 1979. Any person who violates this | ||||||
16 | provision shall be guilty of a Class 4 felony. | ||||||
17 | The State Board of Elections shall promulgate, by October | ||||||
18 | 1, 1987, such regulations as may be necessary to ensure | ||||||
19 | uniformity throughout the State in electronic data processing | ||||||
20 | of voter registration information. The regulations shall | ||||||
21 | include, but need not be limited to, specifications for | ||||||
22 | uniform medium, communications protocol and file structure to | ||||||
23 | be employed by the election authorities of this State in the | ||||||
24 | electronic data processing of voter registration information. | ||||||
25 | Each election authority utilizing electronic data processing | ||||||
26 | of voter registration information shall comply with such |

1 | regulations on and after May 15, 1988. | ||||||
2 | If the applicant for registration was last registered in | ||||||
3 | another county within this State, he shall also sign a | ||||||
4 | certificate authorizing cancellation of the former | ||||||
5 | registration. The certificate shall be in substantially the | ||||||
6 | following form: | ||||||
7 | To the County Clerk of.... County, Illinois. (or) | ||||||
8 | To the Election Commission of the City of ...., Illinois. | ||||||
9 | This is to certify that I am registered in your (county) | ||||||
10 | (city) and that my residence was . | ||||||
11 | Having moved out of your (county) (city), I hereby authorize | ||||||
12 | you to cancel said registration in your office. | ||||||
13 | Dated at ...., Illinois, on (insert date). | ||||||

18 | The cancellation certificate shall be mailed immediately | ||||||
19 | by the County Clerk to the County Clerk (or election | ||||||
20 | commission as the case may be) where the applicant was | ||||||
21 | formerly registered. Receipt of such certificate shall be full | ||||||
22 | authority for cancellation of any previous registration. | ||||||

25 | Sec. 4-10. Except as herein provided, no person shall be |

1 | registered, unless he applies in person to a registration | ||||||
2 | officer, answers such relevant questions as may be asked of | ||||||
3 | him by the registration officer, and executes the affidavit of | ||||||
4 | registration. The registration officer shall require the | ||||||
5 | applicant to furnish two forms of identification, and except | ||||||
6 | in the case of a homeless individual, one of which must include | ||||||
7 | his or her residence address. These forms of identification | ||||||
8 | shall include , but not be limited to, any of the following if | ||||||
9 | valid and unexpired : driver's license ; , social security card ; | ||||||
10 | , public aid identification card ; , utility bill ; , employee | ||||||
11 | or student identification card, lease or contract for a | ||||||
12 | residence ; , credit card, or a civic, union , or professional | ||||||
13 | association membership card ; United States passport; or any | ||||||
14 | other form of identification or documentation issued by the | ||||||
15 | federal, State, or unit of local government that contains the | ||||||
16 | applicant's residential address . The registration officer | ||||||
17 | shall require a homeless individual to furnish evidence of his | ||||||
18 | or her use of the mailing address stated. This use may be | ||||||
19 | demonstrated by a piece of mail addressed to that individual | ||||||
20 | and received at that address or by a statement from a person | ||||||
21 | authorizing use of the mailing address. The registration | ||||||
22 | officer shall require each applicant for registration to read | ||||||
23 | or have read to him the affidavit of registration before | ||||||
24 | permitting him to execute the affidavit. | ||||||
25 | One of the registration officers or a deputy registration | ||||||
26 | officer, county clerk, or clerk in the office of the county |

| |||||||
1 | clerk, shall administer to all persons who shall personally | ||||||
2 | apply to register the following oath or affirmation: | ||||||
3 | "You do solemnly swear (or affirm) that you will fully and | ||||||
4 | truly answer all such questions as shall be put to you touching | ||||||
5 | your name, place of residence, place of birth, your | ||||||
6 | qualifications as an elector and your right as such to | ||||||
7 | register and vote under the laws of the State of Illinois." | ||||||
8 | The registration officer shall satisfy himself that each | ||||||
9 | applicant for registration is qualified to register before | ||||||
10 | registering him. If the registration officer has reason to | ||||||
11 | believe that the applicant is a resident of a Soldiers' and | ||||||
12 | Sailors' Home or any facility which is licensed or certified | ||||||
13 | pursuant to the Nursing Home Care Act, the Specialized Mental | ||||||
14 | Health Rehabilitation Act of 2013, the ID/DD Community Care | ||||||
15 | Act, or the MC/DD Act, the following question shall be put, | ||||||
16 | "When you entered the home which is your present address, was | ||||||
17 | it your bona fide intention to become a resident thereof?" Any | ||||||
18 | voter of a township, city, village or incorporated town in | ||||||
19 | which such applicant resides, shall be permitted to be present | ||||||
20 | at the place of any precinct registration and shall have the | ||||||
21 | right to challenge any applicant who applies to be registered. | ||||||
22 | In case the officer is not satisfied that the applicant is | ||||||
23 | qualified he shall forthwith notify such applicant in writing | ||||||
24 | to appear before the county clerk to complete his | ||||||
25 | registration. Upon the card of such applicant shall be written | ||||||
26 | the word "incomplete" and no such applicant shall be permitted |

1 | to vote unless such registration is satisfactorily completed | ||||||
2 | as hereinafter provided. No registration shall be taken and | ||||||
3 | marked as incomplete if information to complete it can be | ||||||
4 | furnished on the date of the original application. | ||||||
5 | Any person claiming to be an elector in any election | ||||||
6 | precinct and whose registration card is marked "Incomplete" | ||||||
7 | may make and sign an application in writing, under oath, to the | ||||||
8 | county clerk in substance in the following form: | ||||||
9 | "I do solemnly swear that I, ...., did on (insert date) | ||||||
10 | make application to the board of registry of the .... precinct | ||||||
11 | of the township of .... (or to the county clerk of .... county) | ||||||
12 | and that said board or clerk refused to complete my | ||||||

15 | precinct, and am a duly qualified voter of said precinct and am | ||||||
16 | entitled to be registered to vote in said precinct at the next | ||||||

19 | All such applications shall be presented to the county | ||||||
20 | clerk or to his duly authorized representative by the | ||||||
21 | applicant, in person between the hours of 9:00 a.m. and 5:00 | ||||||
22 | p.m. on any day after the days on which the 1969 and 1970 | ||||||
23 | precinct re-registrations are held but not on any day within | ||||||
24 | 27 days preceding the ensuing general election and thereafter | ||||||
25 | for the registration provided in Section 4-7 all such |

1 | applications shall be presented to the county clerk or his | ||||||
2 | duly authorized representative by the applicant in person | ||||||
3 | between the hours of 9:00 a.m. and 5:00 p.m. on any day prior | ||||||
4 | to 27 days preceding the ensuing general election. Such | ||||||
5 | application shall be heard by the county clerk or his duly | ||||||
6 | authorized representative at the time the application is | ||||||
7 | presented. If the applicant for registration has registered | ||||||
8 | with the county clerk, such application may be presented to | ||||||
9 | and heard by the county clerk or by his duly authorized | ||||||
10 | representative upon the dates specified above or at any time | ||||||
11 | prior thereto designated by the county clerk. | ||||||
12 | Any otherwise qualified person who is absent from his | ||||||
13 | county of residence either due to business of the United | ||||||
14 | States or because he is temporarily outside the territorial | ||||||
15 | limits of the United States may become registered by mailing | ||||||
16 | an application to the county clerk within the periods of | ||||||
17 | registration provided for in this Article, or by simultaneous | ||||||
18 | application for registration by mail and vote by mail ballot | ||||||
19 | as provided in Article 20 of this Code. | ||||||
20 | Upon receipt of such application the county clerk shall | ||||||
21 | immediately mail an affidavit of registration in duplicate, | ||||||
22 | which affidavit shall contain the following and such other | ||||||
23 | information as the State Board of Elections may think it | ||||||
24 | proper to require for the identification of the applicant: | ||||||
25 | Name. The name of the applicant, giving surname and first | ||||||
26 | or Christian name in full, and the middle name or the initial |

19 | Updated copies of computer tapes or computer discs or | ||||||
20 | other electronic data processing information containing voter | ||||||
21 | registration information shall be furnished by the county | ||||||
22 | clerk within 10 days after December 15 and May 15 each year and | ||||||
23 | within 10 days after each registration period is closed to the | ||||||
24 | State Board of Elections in a form prescribed by the Board. For | ||||||
25 | the purposes of this Section, a registration period is closed | ||||||
26 | 27 days before the date of any regular or special election. |

1 | Registration information shall include, but not be limited to, | ||||||
2 | the following information: name, sex, residence, telephone | ||||||
3 | number, if any, age, party affiliation, if applicable, | ||||||
4 | precinct, ward, township, county, and representative, | ||||||

6 | noncompliance, the State Board of Elections is directed to | ||||||
7 | obtain compliance forthwith with this nondiscretionary duty of | ||||||

15 | Elections for reimbursement to the election authority for such | ||||||
16 | purpose. The State Board shall furnish copies of such tapes, | ||||||
17 | discs, other electronic data or compilations thereof to state | ||||||
18 | political committees registered pursuant to the Illinois | ||||||
19 | Campaign Finance Act or the Federal Election Campaign Act and | ||||||
20 | to governmental entities, at their request and at a reasonable | ||||||
21 | cost. To protect the privacy and confidentiality of voter | ||||||
22 | registration information, the disclosure of electronic voter | ||||||
23 | registration records to any person or entity other than to a | ||||||
24 | State or local political committee and other than to a | ||||||
25 | governmental entity for a governmental purpose is specifically | ||||||
26 | prohibited except as follows: subject to security measures |

1 | adopted by the State Board of Elections which, at a minimum, | ||||||
2 | shall include the keeping of a catalog or database, available | ||||||
3 | for public view, including the name, address, and telephone | ||||||

6 | voter registration list on a computer screen at the | ||||||
7 | Springfield office of the State Board of Elections, during | ||||||

10 | may not print, duplicate, transmit, or alter the list. Copies | ||||||
11 | of the tapes, discs or other electronic data shall be | ||||||
12 | furnished by the county clerk to local political committees | ||||||
13 | and governmental entities at their request and at a reasonable | ||||||
14 | cost. Reasonable cost of the tapes, discs, et cetera for this | ||||||
15 | purpose would be the cost of duplication plus 15% for | ||||||
16 | administration. The individual representing a political | ||||||
17 | committee requesting copies of such tapes shall make a sworn | ||||||
18 | affidavit that the information shall be used only for bona | ||||||
19 | fide political purposes, including by or for candidates for | ||||||
20 | office or incumbent office holders. Such tapes, discs or other | ||||||
21 | electronic data shall not be used under any circumstances by | ||||||
22 | any political committee or individuals for purposes of | ||||||
23 | commercial solicitation or other business purposes. If such | ||||||
24 | tapes contain information on county residents related to the | ||||||
25 | operations of county government in addition to registration | ||||||
26 | information, that information shall not be used under any |

1 | circumstances for commercial solicitation or other business | ||||||
2 | purposes. The prohibition in this Section against using the | ||||||
3 | computer tapes or computer discs or other electronic data | ||||||
4 | processing information containing voter registration | ||||||
5 | information for purposes of commercial solicitation or other | ||||||
6 | business purposes shall be prospective only from the effective | ||||||
7 | date of this amended Act of 1979. Any person who violates this | ||||||
8 | provision shall be guilty of a Class 4 felony. | ||||||
9 | The State Board of Elections shall promulgate, by October | ||||||
10 | 1, 1987, such regulations as may be necessary to ensure | ||||||
11 | uniformity throughout the State in electronic data processing | ||||||
12 | of voter registration information. The regulations shall | ||||||
13 | include, but need not be limited to, specifications for | ||||||
14 | uniform medium, communications protocol and file structure to | ||||||
15 | be employed by the election authorities of this State in the | ||||||
16 | electronic data processing of voter registration information. | ||||||
17 | Each election authority utilizing electronic data processing | ||||||
18 | of voter registration information shall comply with such | ||||||
19 | regulations on and after May 15, 1988. | ||||||
20 | If the applicant for registration was last registered in | ||||||
21 | another county within this State, he shall also sign a | ||||||
22 | certificate authorizing cancellation of the former | ||||||

18 | other electronic data processing information containing voter | ||||||
19 | registration information shall be furnished by the Board of | ||||||
20 | Election Commissioners within 10 days after December 15 and | ||||||
21 | May 15 each year and within 10 days after each registration | ||||||
22 | period is closed to the State Board of Elections in a form | ||||||
23 | prescribed by the State Board. For the purposes of this | ||||||
24 | Section, a registration period is closed 27 days before the | ||||||
25 | date of any regular or special election. Registration | ||||||
26 | information shall include, but not be limited to, the |

1 | following information: name, sex, residence, telephone number, | ||||||
2 | if any, age, party affiliation, if applicable, precinct, ward, | ||||||
3 | township, county, and representative, legislative and | ||||||
4 | congressional districts. In the event of noncompliance, the | ||||||
5 | State Board of Elections is directed to obtain compliance | ||||||
6 | forthwith with this nondiscretionary duty of the election | ||||||
7 | authority by instituting legal proceedings in the circuit | ||||||

9 | the registration information. The costs of furnishing updated | ||||||
10 | copies of tapes or discs shall be paid at a rate of $.00034 per | ||||||
11 | name of registered voters in the election jurisdiction, but | ||||||
12 | not less than $50 per tape or disc and shall be paid from | ||||||
13 | appropriations made to the State Board of Elections for | ||||||
14 | reimbursement to the election authority for such purpose. The | ||||||
15 | State Board shall furnish copies of such tapes, discs, other | ||||||
16 | electronic data or compilations thereof to state political | ||||||
17 | committees registered pursuant to the Illinois Campaign | ||||||
18 | Finance Act or the Federal Election Campaign Act and to | ||||||
19 | governmental entities, at their request and at a reasonable | ||||||
20 | cost. To protect the privacy and confidentiality of voter | ||||||
21 | registration information, the disclosure of electronic voter | ||||||
22 | registration records to any person or entity other than to a | ||||||
23 | State or local political committee and other than to a | ||||||
24 | governmental entity for a governmental purpose is specifically | ||||||
25 | prohibited except as follows: subject to security measures | ||||||
26 | adopted by the State Board of Elections which, at a minimum, |

1 | shall include the keeping of a catalog or database, available | ||||||
2 | for public view, including the name, address, and telephone | ||||||
3 | number of the person viewing the list as well as the time of | ||||||
4 | that viewing, any person may view the centralized statewide | ||||||
5 | voter registration list on a computer screen at the | ||||||
6 | Springfield office of the State Board of Elections, during | ||||||
7 | normal business hours other than during the 27 days before an | ||||||
8 | election, but the person viewing the list under this exception | ||||||
9 | may not print, duplicate, transmit, or alter the list. Copies | ||||||
10 | of the tapes, discs or other electronic data shall be | ||||||
11 | furnished by the Board of Election Commissioners to local | ||||||
12 | political committees and governmental entities at their | ||||||
13 | request and at a reasonable cost. Reasonable cost of the | ||||||
14 | tapes, discs, et cetera for this purpose would be the cost of | ||||||
15 | duplication plus 15% for administration. The individual | ||||||
16 | representing a political committee requesting copies of such | ||||||
17 | tapes shall make a sworn affidavit that the information shall | ||||||
18 | be used only for bona fide political purposes, including by or | ||||||
19 | for candidates for office or incumbent office holders. Such | ||||||
20 | tapes, discs or other electronic data shall not be used under | ||||||
21 | any circumstances by any political committee or individuals | ||||||
22 | for purposes of commercial solicitation or other business | ||||||
23 | purposes. If such tapes contain information on county | ||||||
24 | residents related to the operations of county government in | ||||||
25 | addition to registration information, that information shall | ||||||
26 | not be used under any circumstances for commercial |

1 | solicitation or other business purposes. The prohibition in | ||||||
2 | this Section against using the computer tapes or computer | ||||||
3 | discs or other electronic data processing information | ||||||
4 | containing voter registration information for purposes of | ||||||
5 | commercial solicitation or other business purposes shall be | ||||||
6 | prospective only from the effective date of this amended Act | ||||||
7 | of 1979. Any person who violates this provision shall be | ||||||
8 | guilty of a Class 4 felony. | ||||||
9 | The State Board of Elections shall promulgate, by October | ||||||
10 | 1, 1987, such regulations as may be necessary to ensure | ||||||
11 | uniformity throughout the State in electronic data processing | ||||||
12 | of voter registration information. The regulations shall | ||||||
13 | include, but need not be limited to, specifications for | ||||||
14 | uniform medium, communications protocol and file structure to | ||||||
15 | be employed by the election authorities of this State in the | ||||||
16 | electronic data processing of voter registration information. | ||||||
17 | Each election authority utilizing electronic data processing | ||||||
18 | of voter registration information shall comply with such | ||||||
19 | regulations on and after May 15, 1988. | ||||||
20 | If the applicant for registration was last registered in | ||||||
21 | another county within this State, he shall also sign a | ||||||
22 | certificate authorizing cancellation of the former | ||||||
23 | registration. The certificate shall be in substantially the | ||||||

20 | applicant for registration is qualified to register before | ||||||

23 | permitted to be present at the place of registration, and | ||||||
24 | shall have the right to challenge any applicant who applies to | ||||||
