Bill Title: Amends the State Comptroller Act, the Illinois State Collection Act of 1986, and the Illinois Income Tax Act. Provides that the Department of Revenue may enter into a reciprocal offset agreement with the Office of the State Comptroller and the Secretary of the Treasury of the United States, or his or her delegate, which provides for (i) the use of the Comptroller's offset system to offset State payments to collect federal nontax debts and for the Comptroller to charge a fee up to $25 per transaction for such offsets and (ii) offsetting federal payments, as authorized by federal law, to collect State debts, State tax, and nontax obligations. Sets forth the requirements for the agreement. Makes other changes.

AN ACT concerning State government.
| ||||
Be it enacted by the People of the State of Illinois,
| ||||
represented in the General Assembly:
| ||||
Section 5. The State Finance Act is amended by adding | ||||
Sections 5.786, 5.787, 6z-87, and 6z-88 as follows:

Sec. 5.786. The Illinois State Crime Stoppers Association | ||||
Fund.

Sec. 5.787. The After-School Rescue Fund.

(30 ILCS 105/6z-87 new) | ||||
Sec. 6z-87. Illinois State Crime Stoppers Association | ||||
Fund. The Illinois State Crime Stoppers Association Fund is | ||||
created as a special fund in the State treasury. Subject to | ||||
appropriation, the Fund shall be used by the Criminal Justice | ||||
Information Authority to make grants to the Illinois State | ||||
Crime Stoppers Association to enhance and develop Crime | ||||
Stoppers programs in Illinois.

(30 ILCS 105/6z-88 new) | ||||
Sec. 6z-88. After-School Rescue Fund; creation. The |
After-School Rescue Fund is created as a special fund in the | ||
State treasury. Moneys in the Fund shall be used by the | ||
Illinois State Board of Education for the making of grants to | ||
at-risk schools for the promotion of extracurricular and | ||
after-school programs.

Section 10. The Illinois Income Tax Act is amended by | ||
adding Sections 507YY and 507ZZ as follows:

Sec. 507YY. Crime Stoppers checkoff. For taxable years | ||
ending on or after December 31, 2011, the Department shall | ||
print, on its standard individual income tax form, a provision | ||
indicating that, if the taxpayer wishes to contribute to the | ||
Illinois State Crime Stoppers Association Fund, as authorized | ||
by this amendatory Act of the 97th General Assembly, then he or | ||
she may do so by stating the amount of the contribution (not | ||
less than $1) on the return and indicating that the | ||
contribution will reduce the taxpayer's refund or increase the | ||
amount of payment to accompany the return. The taxpayer's | ||
failure to remit any amount of the increased payment reduces | ||
the contribution accordingly. This Section does not apply to | ||
any amended return.

(35 ILCS 5/507ZZ new) | ||
Sec. 507ZZ. After-School Rescue Fund checkoff. For taxable
|
years ending on or after December 31, 2011, the Department must

(i) indicating that if the taxpayer wishes to contribute to the
| ||
After-School Rescue Fund, as authorized by this amendatory Act | ||
of

(ii) stating that the contribution will reduce the | ||
taxpayer's refund or
increase the amount of payment to | ||
accompany the return. Failure
to remit any amount of increased | ||
payment shall reduce the
contribution accordingly. This | ||
Section does not apply to any
amended return.

Section 99. Effective date. This Act takes effect upon | ||
becoming law.
