Bill Title: Amends the Video Gaming Act. Provides that the Illinois Gaming Board must provide a licensed establishment, licensed truck stop establishment, licensed fraternal establishment, or licensed veterans establishment that violates the Act written notice of the violation within 15 days after the violation. Provides that video gaming terminals in a licensed truck stop establishment must be located in an area restricted to persons over 21 years of age and the entrance to the area must be within the view of at least one employee of the establishment who is over 21 years of age, or monitored through a closed circuit television monitor located on the premises and within the direct view of at least one employee of the establishment who is over 21 years of age (rather than located in an area restricted to persons over 21 years of age the entrance to which is within the view of at least one employee, who is over 21 years of age, of the licensed truck stop establishment). Makes conforming changes. Effective immediately.

1 | AN ACT concerning gaming.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Video Gaming
Act is amended by adding | ||||||
5 | Sections 43 and 79.5 and by changing Section 58 as follows:

6 | (230 ILCS 40/43 new) | ||||||
7 | Sec. 43. Notice of alleged violation of Section 40. In all | ||||||
8 | instances of an alleged violation of Section 40, the Board or | ||||||
9 | its agents or designees shall provide written notice of the | ||||||
10 | alleged violation to the affected licensed establishment, | ||||||
11 | licensed fraternal establishment, licensed veterans | ||||||
12 | establishment, or licensed truck stop establishment within 15 | ||||||
13 | days after the alleged occurrence of the violation.

15 | Sec. 58. Location of terminals. Video gaming terminals in | ||||||
16 | a licensed establishment, licensed fraternal establishment, or | ||||||
17 | licensed veterans establishment must be located

10 | The placement of video gaming terminals in licensed | ||||||
11 | establishments, licensed truck stop establishments, licensed | ||||||
12 | fraternal establishments, and licensed veterans establishments | ||||||
13 | shall be subject to the rules promulgated by the Board pursuant | ||||||
14 | to the Illinois Administrative Procedure Act.

17 | Sec. 79.5. Enforcement actions. The Board shall establish | ||||||
18 | a policy and standards for compliance operations to investigate | ||||||
19 | whether a licensed establishment, licensed fraternal | ||||||
20 | establishment, licensed veterans establishment, or a licensed | ||||||
21 | truck stop establishment is: (1) permitting any person under | ||||||
22 | the age of 21 years to use or play a video gaming terminal in | ||||||
23 | violation of this Act; or (2) furnishing alcoholic liquor to | ||||||
24 | persons under 21 years of age in violation of the Liquor | ||||||
25 | Control Act of 1934. |

1 | The policy and standards for compliance operations under | ||||||
2 | this Section shall be similar to the model policy and | ||||||
3 | guidelines for the operation of alcohol and tobacco compliance | ||||||
4 | checks by local law enforcement officers adopted by the | ||||||
5 | Illinois Law Enforcement Training Standards Board pursuant to | ||||||
6 | subsection (c) of Section 6-16.1 of the Liquor Control Act of | ||||||
7 | 1934. The Board shall adopt the policy and standards in the | ||||||
8 | form of emergency rulemaking that shall be adopted no later | ||||||
9 | than 90 days after the effective date of this amendatory Act of | ||||||
10 | the 100th General Assembly and shall be immediately followed by | ||||||
11 | permanent rulemaking on the same subject. | ||||||
12 | A licensed establishment, licensed fraternal | ||||||
13 | establishment, licensed veterans establishment, or licensed | ||||||
14 | truck stop establishment that is the subject of an enforcement | ||||||
15 | action under this Section and is found, pursuant to the | ||||||
16 | enforcement action, to be in compliance with this Act shall be | ||||||
17 | notified by the Board that no violation was found within 30 | ||||||
18 | days after the finding.
