Bill Title: Amends various Acts relating to the governance of public universities and community colleges in Illinois. Provides that, in determining whether an individual is an Illinois resident, if the individual enrolls or attains credits at a public or private elementary school in this State, a public or private high school in this State, an adult school organized under the Public Community College Act, or a community college campus organized under the Public Community College Act, or either graduated from a public or private high school or received the equivalent of a high school diploma in this State, attained an associate degree from a community college campus organized under the Public Community College Act, or fulfills of the minimum transfer requirements established by the college for students transferring from a campus of a community college campus organized under the Public Community College Act, then the individual can qualify as a resident (instead of resided with his or her parent or guardian while attending a public or private high school in this State or individual graduated from a public or private high school or received the equivalent of a high school diploma in this State). Removes the requirement that the individual must attend school in this State for at least 3 years as of the date the individual graduated from high school or received the equivalent of a high school diploma to qualify as an Illinois resident.

Amends various Acts relating to the governance of public universities and community colleges in Illinois. 1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The University of Illinois Act is amended by
5changing the title of the Act and Section 7e-5 as follows:
6 (110 ILCS 305/7e-5)
7 Sec. 7e-5. In-state tuition charge.
8 (a) Notwithstanding any other provision of law to the
9contrary, at a minimum, for tuition purposes, the Board of
10Trustees shall deem an individual an Illinois resident, until
11the individual establishes a residence outside of this State,
12if all of the following conditions are met:
13 (1) The individual enrolls in or attains credits at
14 any of the following: The individual resided with his or
15 her parent or guardian while attending a public or private
16 high school in this State.
17 (A) a public or private elementary school in this
18 State;
19 (B) a public or private high school in this State;
20 (C) an adult school organized under the Public
21 Community College Act; or
22 (D) a community college campus organized under the
23 Public Community College Act.

1 (2) The individual satisfies any of the following:
2 (A) the The individual graduated from a public or
3 private high school or received the equivalent of a
4 high school diploma in this State; .
5 (B) the individual attained an associate's degree
6 from a community college campus organized under the
7 Public Community College Act; or
8 (C) the individual fulfilled the minimum transfer
9 requirements established by the University of Illinois
10 for students transferring from a campus of a community
11 college campus organized under the Public Community
12 College Act.
13 (3) (Blank.) The individual attended school in this
14 State for at least 3 years as of the date the individual
15 graduated from high school or received the equivalent of a
16 high school diploma.
17 (4) The individual registers as an entering student in
18 the University not earlier than the 2003 fall semester.
19 (5) In the case of an individual who is not a citizen
20 or a permanent resident of the United States, the
21 individual provides the University with an affidavit
22 stating that the individual will file an application to
23 become a permanent resident of the United States at the
24 earliest opportunity the individual is eligible to do so.
25 This subsection (a) applies only to tuition for a term or
26semester that begins on or after May 20, 2003 (the effective

1date of Public Act 93-7). Any revenue lost by the University in
2implementing this subsection (a) shall be absorbed by the
3University Income Fund.
4 (b) If a person is on active military duty and stationed in
5Illinois, then the Board of Trustees shall deem that person
6and any of his or her dependents Illinois residents for
7tuition purposes. Beginning with the 2009-2010 academic year,
8if a person is on active military duty and is stationed out of
9State, but he or she was stationed in this State for at least 3
10years immediately prior to being reassigned out of State, then
11the Board of Trustees shall deem that person and any of his or
12her dependents Illinois residents for tuition purposes, as
13long as that person or his or her dependent (i) applies for
14admission to the University within 18 months of the person on
15active military duty being reassigned or (ii) remains
16continuously enrolled at the University. Beginning with the
172013-2014 academic year, if a person is utilizing benefits
18under the federal Post-9/11 Veterans Educational Assistance
19Act of 2008 or any subsequent variation of that Act, then the
20Board of Trustees shall deem that person an Illinois resident
21for tuition purposes. Beginning with the 2015-2016 academic
22year, if a person is utilizing benefits under the federal
23All-Volunteer Force Educational Assistance Program, then the
24Board of Trustees shall deem that person an Illinois resident
25for tuition purposes. Beginning with the 2019-2020 academic
26year, per the federal requirements for maintaining approval

1for veterans' education benefits under 38 U.S.C. 3679(c), if a
2person is on active military duty or is receiving veterans'
3education benefits, then the Board of Trustees shall deem that
4person an Illinois resident for tuition purposes for any
5academic quarter, semester, or term, as applicable.

7 Section 10. The Southern Illinois University Management
8Act is amended by changing the title of the Act and Section
98d-5 as follows:

13contrary, at a minimum, for tuition purposes, the Board shall
14deem an individual an Illinois resident, until the individual
15establishes a residence outside of this State, if all of the

18 any of the following: The individual resided with his or
19 her parent or guardian while attending a public or private
20 high school in this State.

17 State for at least 3 years as of the date the individual
18 graduated from high school or received the equivalent of a
19 high school diploma.
20 (4) The individual registers as an entering student in

16deem an individual an Illinois resident, until the individual

1deem an individual an Illinois resident, until the individual
2establishes a residence outside of this State, if all of the
3following conditions are met:
4 (1) The individual enrolls in or attains credits at
5 any of the following: The individual resided with his or
6 her parent or guardian while attending a public or private
7 high school in this State.
8 (A) a public or private elementary school in this
9 State;
10 (B) a public or private high school in this State;
11 (C) an adult school organized under the Public
12 Community College Act; or
13 (D) A community college campus organized under the
14 Public Community College Act.
15 (2) The individual satisfies any of the following:
16 (A) the The individual graduated from a public or
17 private high school or received the equivalent of a
18 high school diploma in this State.
19 (B) the individual attained an associate's degree
20 from a community college campus organized under the
21 Public Community College Act; or
22 (C) the individual fulfilled the minimum transfer
23 requirements established by Northern Illinois
24 University for students transferring from a campus of
25 a community college campus organized under the Public
26 Community College Act.

1 (3) (Blank.) The individual attended school in this
2 State for at least 3 years as of the date the individual
3 graduated from high school or received the equivalent of a
4 high school diploma.
5 (4) The individual registers as an entering student in
6 the University not earlier than the 2003 fall semester.
7 (5) In the case of an individual who is not a citizen
8 or a permanent resident of the United States, the
9 individual provides the University with an affidavit
10 stating that the individual will file an application to
11 become a permanent resident of the United States at the
12 earliest opportunity the individual is eligible to do so.
13 This subsection (a) applies only to tuition for a term or
14semester that begins on or after May 20, 2003 (the effective
15date of Public Act 93-7). Any revenue lost by the University in
16implementing this subsection (a) shall be absorbed by the
17University Income Fund.
18 (b) If a person is on active military duty and stationed in
19Illinois, then the Board shall deem that person and any of his
20or her dependents Illinois residents for tuition purposes.
21Beginning with the 2009-2010 academic year, if a person is on
22active military duty and is stationed out of State, but he or
23she was stationed in this State for at least 3 years
24immediately prior to being reassigned out of State, then the
25Board shall deem that person and any of his or her dependents
26Illinois residents for tuition purposes, as long as that

1person or his or her dependent (i) applies for admission to the
2University within 18 months of the person on active military
3duty being reassigned or (ii) remains continuously enrolled at
4the University. Beginning with the 2013-2014 academic year, if
5a person is utilizing benefits under the federal Post-9/11
6Veterans Educational Assistance Act of 2008 or any subsequent
7variation of that Act, then the Board shall deem that person an
8Illinois resident for tuition purposes. Beginning with the
92015-2016 academic year, if a person is utilizing benefits
10under the federal All-Volunteer Force Educational Assistance
11Program, then the Board shall deem that person an Illinois
12resident for tuition purposes. Beginning with the 2019-2020
13academic year, per the federal requirements for maintaining
14approval for veterans' education benefits under 38 U.S.C.
153679(c), if a person is on active military duty or is receiving
16veterans' education benefits, then the Board of Trustees shall
17deem that person an Illinois resident for tuition purposes for
18any academic quarter, semester, or term, as applicable.

20 Section 40. The Western Illinois University Law is amended
21by changing the title of the Act and Section 35-88 as follows:

23 Sec. 35-88. In-state tuition charge.
24 (a) Notwithstanding any other provision of law to the
