1 AN ACT concerning education.
2 Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
4 Section 5. The School Construction Law is amended by
5changing Section 5-40 as follows:
6 (105 ILCS 230/5-40)
7 Sec. 5-40. Supervision of school construction projects;
8green projects. The The Capital Development Board shall
9exercise general supervision over school construction projects
10financed pursuant to this Article. School districts, however,
11must be allowed to choose the architect and engineer for their
12school construction projects, and no project may be disapproved
13by the State Board of Education or the Capital Development
14Board solely due to a school district's selection of an
15architect or engineer.
16 With respect to those school construction projects for
17which a school district first applies for a grant on or after
18July 1, 2007, the school construction project must receive
19certification from the United States Green Building Council's
20Leadership in Energy and Environmental Design Green Building
21Rating System or the Green Building Initiative's Green Globes
22Green Building Rating System or must meet green building
23standards of the Capital Development Board and its Green

1Building Advisory Committee. With respect to those school
2construction projects for which a school district applies for a
3grant on or after July 1, 2009, the school construction project
4must receive silver certification from the United States Green
5Building Council's Leadership in Energy and Environmental
6Design Green Building Rating System unless all of the following
7are met:
8 (1) the application submitted can be categorized as a
9 capital need prioritized under item (1) of Section 5-30 of
10 this Law;
11 (2) the renovation or replacement school construction
12 project is less than 40% replacement cost, or the project
13 has been granted a waiver by the Capital Development Board
14 in consultation with the State Board of Education in
15 accordance with rules promulgated pursuant to this Law;
16 (3) the school construction project is located in a
17 county that borders the Mississippi River with a population
18 of more than 33,000 and less than 34,000, according to the
19 2010 decennial census;
20 (4) the school district for which the school
21 construction grant will be issued has no more than 1,100
22 students, with the relevant school facility housing no more
23 than 700 students;
24 (5) the facilities for which the school construction
25 grant will be used have been condemned as of July 23, 2012;
26 and

1 (6) the application for the school construction grant
2 has been approved prior to the effective date of this
3 amendatory Act of the 98th General Assembly.
