Bill Title: Amends the Higher Education Cooperation Act. Provides that the purpose of the Act is to promote interinstitutional cooperation and collaboration, which may involve public-private partnerships leveraging the use of public and private resources to improve outcomes for the higher educational system in this State. Provides that an institution of higher education may participate in the establishment and operation of programs of interinstitutional cooperation with other institutions of higher education or public-private partnerships, or both (instead of allowing a public institution of higher education to participate in the establishment and operation of programs of interinstitutional cooperation with other public institutions of higher education or with nonpublic institutions of higher education or with both public and nonpublic institutions of higher education). Provides that the program of financial assistance is available to public-private partnerships. Provides that the Board of Higher Education may require matching public or private resources from all participants. Makes related changes. Effective July 1, 2016.

1 | AN ACT concerning education.
| ||||||
2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Higher Education Cooperation Act is amended | ||||||
5 | by changing Sections 2, 3, 4, and 5 and by adding Section 2.5 | ||||||
6 | as follows:
| ||||||
7 | (110 ILCS 220/2) (from Ch. 144, par. 282)
| ||||||
8 | Sec. 2. As used in this Act, unless the context otherwise | ||||||
9 | requires:
| ||||||
10 | "Board" means the Board of Higher Education . ;
| ||||||
11 | "Nonpublic institution of higher education" means a | ||||||
12 | nonpublic college or university that (i) has been authorized to | ||||||
13 | operate within the State of Illinois pursuant to the Private | ||||||
14 | College Act or the Academic Degree Act, (ii) has been in | ||||||
15 | continuous operation and has granted degrees within the State | ||||||
16 | of Illinois since before the effective date of both the Private | ||||||
17 | College Act and the Academic Degree Act and has not modified | ||||||
18 | the business entity since the effective date of both the | ||||||
19 | Private College Act and the Academic Degree Act, or (iii) has | ||||||
20 | been authorized pursuant to the Private Business and Vocational | ||||||
21 | Schools Act of 2012. an educational
organization, other than a | ||||||
22 | public institution of higher education, which
provides a | ||||||
23 | minimum of an organized 2 year program at the private junior |

level or higher and which operates not-for-profit and | ||||||
2 | in conformity with
standards substantially equivalent to those | ||||||
3 | of the public institutions of
higher education;
| ||||||
4 | "Private partner" means a private business, industry, | ||||||
5 | labor organization, not-for-profit organization, association, | ||||||
6 | foundation, or corporation that partners with one or more | ||||||
7 | public institutions of higher education or with one or more | ||||||
8 | nonpublic institutions of higher education or with both public | ||||||
9 | and nonpublic institutions of higher education pursuant to an | ||||||
10 | agreement under this Act. | ||||||
11 | "Private resources" means support, whether financial or | ||||||
12 | in-kind assistance, from a private partner that may be used to | ||||||
13 | provide matching support under this Act. | ||||||
14 | "Public institution of higher education" means the | ||||||
15 | University of
Illinois, Southern Illinois University,
Chicago | ||||||
16 | State University, Eastern Illinois University, Governors State
| ||||||
17 | University, Illinois State University, Northeastern Illinois | ||||||
18 | University,
Northern Illinois University, Western Illinois | ||||||
19 | University, the public community
colleges of
this State, and | ||||||
20 | any
other public universities, colleges and community colleges
| ||||||
21 | now or hereafter
established or authorized by the General | ||||||
22 | Assembly.
| ||||||
23 | "Public-private partnership" means an agreement pursuant | ||||||
24 | to this Act between one or more public institutions of higher | ||||||
25 | education and a nonpublic institution of higher education, a | ||||||
26 | private partner, or a combination of both that leverages |

| |||||||
1 | resources from all parties to improve higher education | ||||||
2 | outcomes. | ||||||
3 | "Public resources" means support, whether financial or | ||||||
4 | in-kind assistance, from a public entity that may be used to | ||||||
5 | provide matching support under this Act. | ||||||

8 | Sec. 2.5. Purpose. The purpose of this Act is to promote | ||||||
9 | interinstitutional cooperation and public-private partnerships | ||||||
10 | in order to leverage the use of public and private resources to | ||||||
11 | provide workforce-valuable postsecondary education to improve | ||||||
12 | outcomes for the higher educational system in this State.

14 | Sec. 3.
Any public institution of higher education may | ||||||
15 | participate in the
establishment and operation of programs of | ||||||
16 | interinstitutional cooperation
with other public institutions | ||||||
17 | of higher education , or with nonpublic
institutions of higher | ||||||
18 | education , or with both public and nonpublic
institutions of | ||||||
19 | higher education , or with private partners . Such participation | ||||||
20 | may be by contract or
by other means , including , but not | ||||||
21 | limited to , the designation of
representatives of the | ||||||
22 | institution as directors of not-for-profit
corporations | ||||||
23 | organized for the governance or administration of any such
| ||||||
24 | program. Public institutions of higher education may |
| |||||||
| |||||||
1 | participate in programs of
interinstitutional cooperation or | ||||||
2 | public-private partnerships that programs which involve | ||||||
3 | institutions or private partners based outside this
State.

6 | Sec. 4.
A program of financial assistance to programs of | ||||||
7 | interinstitutional
cooperation and public-private | ||||||
8 | partnerships , in higher education is established to implement | ||||||
9 | the policy of
encouraging such cooperation in order to achieve | ||||||
10 | an efficient use of
educational resources, an equitable | ||||||
11 | distribution of educational services,
the development of | ||||||
12 | innovative concepts and applications, and other public
| ||||||
13 | purposes.
| ||||||
14 | The Board of Higher Education shall administer this program | ||||||
15 | of financial
assistance and shall distribute the funds | ||||||
16 | appropriated by the General
Assembly for this purpose in the | ||||||
17 | form of grants to not-for-profit
corporations organized to | ||||||
18 | administer programs of interinstitutional
cooperation in | ||||||
19 | higher education or to public or nonpublic institutions of
| ||||||
20 | higher education participating in such programs .
| ||||||
21 | In awarding grants to interinstitutional programs and | ||||||
22 | public-private partnerships under this Act, the
Board shall | ||||||
23 | consider in relation to each such program whether it serves the
| ||||||
24 | public purposes expressed in this Act, whether the local | ||||||
25 | community is
substantially involved, whether its function |
| |||||||

1 | could be performed better by a
single existing institution, | ||||||
2 | whether the program is consistent with the
Illinois master plan | ||||||
3 | for higher education, and such other criteria as it
determines | ||||||
4 | to be appropriate.
| ||||||
5 | No grant may be awarded under this Section for any program | ||||||
6 | of sectarian
instruction or for any program designed to serve a | ||||||
7 | sectarian purpose.

8 | As a part of its administration of this Act , the Board may | ||||||
9 | require
audits or reports in relation to the administrative, | ||||||
10 | fiscal , and academic aspects of
any program of | ||||||
11 | interinstitutional cooperation or public-private partnership | ||||||
12 | program for which a grant is awarded under this Act. The Board | ||||||
13 | may require the contribution of matching resources.
The Board | ||||||
14 | shall annually submit to the Governor and the General Assembly | ||||||
15 | a
budgetary recommendation for grants under this Act.

18 | Sec. 5.
Any not-for-profit corporation organized to | ||||||
19 | administer a program of an
interinstitutional cooperation | ||||||
20 | program of higher education or public-private partnership may | ||||||
21 | be recognized under this
Section if it has been in existence | ||||||
22 | for 3 years or longer, it is structured
for continuing | ||||||
23 | operation, it is substantial in scope, it is oriented to and
| ||||||
24 | supported by the community in which it is located , and it is | ||||||
25 | consistent with
the Illinois master plan for higher education.

1 | In each request of the Board of Higher Education to the | ||||||
2 | General Assembly
for the appropriation of funds for the purpose | ||||||
3 | of making grants under this
Act the Board shall specify the | ||||||
4 | amount of the grant proposed for each
not-for-profit | ||||||
5 | corporation recognized under this Section.
| ||||||
6 | The following not-for-profit corporations are recognized | ||||||
7 | for the
purposes of this Section:

8 | The Quad Cities Graduate Study Center.
