Bill Title: Amends the Criminal Code of 2012. Creates the offense of possession of a relay vehicle theft device. Provides that a person commits the offense when he or she knowingly possesses a relay vehicle theft device. Exempts from a violation: (1) an employee of a facility subject to the Automotive Repair Act or the Automotive Collision Repair Act; (2) a new vehicle dealer or used vehicle dealer licensed under the Illinois Vehicle Code; (3) a locksmith licensed under the Private Detective, Private Alarm, Private Security, Fingerprint Vendor, and Locksmith Act of 2004; (4) a repossession agent; or (5) a federal, State, or local law enforcement officer. Provides that possession of a relay vehicle theft device is a Class 3 felony. Defines "relay vehicle theft device". Effective immediately.

1 | AN ACT concerning criminal law.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Criminal Code of 2012 is amended by adding | |||||||||||||||||||
5 | Section 19-2.1 as follows:

6 | (720 ILCS 5/19-2.1 new) | |||||||||||||||||||
7 | Sec. 19-2.1. Possession of a relay vehicle theft device. | |||||||||||||||||||
8 | (a) In this Section, "relay vehicle theft device" means a | |||||||||||||||||||
9 | device designed to capture a signal from the key fob of a motor | |||||||||||||||||||
10 | vehicle to unlock and start the motor vehicle without the use | |||||||||||||||||||
11 | or possession of the motor vehicle key. | |||||||||||||||||||
12 | (b) A person commits possession of a relay vehicle theft | |||||||||||||||||||
13 | device when he or she knowingly possesses a relay vehicle | |||||||||||||||||||
14 | theft device. | |||||||||||||||||||
15 | (c) This Section does not apply to: | |||||||||||||||||||
16 | (1) an employee of a facility subject to the | |||||||||||||||||||
17 | Automotive Repair Act or the Automotive Collision Repair | |||||||||||||||||||
18 | Act; | |||||||||||||||||||
19 | (2) a new vehicle dealer or used vehicle dealer | |||||||||||||||||||
20 | licensed under Section 5-101 or 5-102 of the Illinois | |||||||||||||||||||
21 | Vehicle Code; | |||||||||||||||||||
22 | (3) a locksmith licensed under the Private Detective, | |||||||||||||||||||
23 | Private Alarm, Private Security, Fingerprint Vendor, and |

5 | (d) Sentence.
Possession of a relay vehicle theft device | ||||||
6 | is a Class 3 felony.

7 | Section 99. Effective date. This Act takes effect upon | ||||||
8 | becoming law.
