Bill Title: Amends the Local Governmental and Governmental Employees Tort Immunity Act. Provides that neither a local public entity nor a public employee is liable for an injury where the liability is based on the existence of a condition of any public property intended or permitted to be used for library purposes, unless that local entity or public employee is guilty of willful and wanton conduct proximately causing the injury. Effective immediately.

AMENDMENT TO SENATE BILL 3426
AMENDMENT NO. ______. Amend Senate Bill 3426 by replacing
everything after the enacting clause with the following:
"Section 5. The Local Governmental and Governmental
Employees Tort Immunity Act is amended by adding Section
3-106.1 as follows:
(745 ILCS 10/3-106.1 new)
Sec. 3-106.1. Property used for public library purposes.
Neither a local public entity nor a public employee is liable
for an injury where the liability is based on the existence of
a condition of any public property intended or permitted to be
used for library purposes, including, but not limited to, open
areas, buildings, grounds, rooms, or motor vehicles, unless
that local entity or public employee is guilty of willful and
wanton conduct proximately causing the injury.

Section 99. Effective date. This Act takes effect upon
becoming law.".
