Bill Title: Amends the Humane Euthanasia in Animal Shelters Act. Provides that, beginning July 1, 2024, an animal shelter may not euthanize any dog, cat, or other domesticated animal. Effective July 1, 2024.

2 | Be it enacted by the People of the State of Illinois, | |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Humane Euthanasia in Animal Shelters Act is | |||||||||||||||||||
5 | amended by changing Section 25 as follows:

7 | Sec. 25. Euthanasia agency. | |||||||||||||||||||
8 | (a) To be certified as a euthanasia agency, an entity must | |||||||||||||||||||
9 | apply to the Department, hold an active license under the | |||||||||||||||||||
10 | Animal Welfare Act as an animal control facility or an animal | |||||||||||||||||||
11 | shelter, pay the required fee, and agree to: | |||||||||||||||||||
12 | (1) Keep euthanasia drugs in a securely locked cabinet | |||||||||||||||||||
13 | or a metal safe that meets the requirements of the | |||||||||||||||||||
14 | Illinois Controlled Substances Act and rules adopted under | |||||||||||||||||||
15 | that Act when not in use. A temporary storage cabinet may | |||||||||||||||||||
16 | be used when a euthanasia technician is on duty and | |||||||||||||||||||
17 | animals are being euthanized during the workday. | |||||||||||||||||||
18 | (2) Comply with the requirements of the Illinois Food, | |||||||||||||||||||
19 | Drug and Cosmetic Act, federal Food, Drug and Cosmetic Act | |||||||||||||||||||
20 | (21 U.S.C. 301 et seq. (1976)), federal Controlled | |||||||||||||||||||
21 | Substances Act (21 U.S.C. 801 et seq. (1976)), and the | |||||||||||||||||||
22 | Illinois Controlled Substances Act. | |||||||||||||||||||
23 | (3) Keep the conditions of the euthanasia area clean |

1 | and sanitary with adequate equipment and supplies to | ||||||
2 | enable the humane disposition of animals. | ||||||
3 | (b) A euthanasia agency may purchase, store, and possess | ||||||
4 | Schedule II and Schedule III (nonnarcotic controlled | ||||||
5 | substances) drugs for the euthanization of animals upon | ||||||
6 | obtaining from the Department an Illinois controlled | ||||||
7 | substances license pursuant to the Illinois Controlled | ||||||
8 | Substances Act and a controlled substance license issued by | ||||||
9 | the Drug Enforcement Administration pursuant to the federal | ||||||
10 | Controlled Substances Act. | ||||||
11 | (c) The Department shall inspect the facility prior to the | ||||||
12 | issuance of the controlled substance license. | ||||||
13 | (d) The euthanasia agency shall notify the Department in | ||||||
14 | writing within 30 days of the time that the employment of a | ||||||
15 | euthanasia technician is terminated from the euthanasia | ||||||
16 | agency. | ||||||
17 | (e) Notwithstanding any other law, no animal shelter shall | ||||||
18 | be allowed to euthanize any dog, cat, or other domesticated | ||||||
19 | animal returned or found on the street beginning July 1, 2024. | ||||||
