Bill Title: Amends the Medical Assistance Article of the Illinois Public Aid Code. In a provision requiring the Department of Healthcare and Family Services to pay the DCFS per diem rate for inpatient psychiatric stays at free-standing psychiatric hospitals or hospitals with a pediatric or adolescent inpatient psychiatric unit, removes language making the provision operative only through July 1, 2023.

1 | AN ACT concerning public aid.

2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
3 | represented in the General Assembly:

4 | Section 5. The Illinois Public Aid Code is amended by | |||||||||||||||||||
5 | changing Section 5-5.07 as follows:
| |||||||||||||||||||
6 | (305 ILCS 5/5-5.07) | |||||||||||||||||||
7 | Sec. 5-5.07. Inpatient psychiatric stay; DCFS per diem | |||||||||||||||||||
8 | rate. The Department of Children and Family Services shall pay | |||||||||||||||||||
9 | the DCFS per diem rate for inpatient psychiatric stay at a | |||||||||||||||||||
10 | free-standing psychiatric hospital or a hospital with a | |||||||||||||||||||
11 | pediatric or adolescent inpatient psychiatric unit effective | |||||||||||||||||||
12 | the 11th day when a child is in the hospital beyond medical | |||||||||||||||||||
13 | necessity, and the parent or caregiver has denied the child | |||||||||||||||||||
14 | access to the home and has refused or failed to make provisions | |||||||||||||||||||
15 | for another living arrangement for the child or the child's | |||||||||||||||||||
16 | discharge is being delayed due to a pending inquiry or | |||||||||||||||||||
17 | investigation by the Department of Children and Family | |||||||||||||||||||
18 | Services. If any portion of a hospital stay is reimbursed | |||||||||||||||||||
19 | under this Section, the hospital stay shall not be eligible | |||||||||||||||||||
20 | for payment under the provisions of Section 14-13 of this | |||||||||||||||||||
21 | Code. This Section is inoperative on and after July 1, 2021. | |||||||||||||||||||
22 | Notwithstanding the provision of Public Act 101-209 stating | |||||||||||||||||||
23 | that this Section is inoperative on and
after July 1, 2020, |
