Bill Title: Proposes to amend the Finance Article of the Illinois Constitution. Provides that any State mandate regarding any subject matter that necessitates additional expenditures from the revenues of units of local government shall be void and unenforceable unless the General Assembly makes necessary appropriations to implement that mandate. Provides that the failure of the General Assembly to make necessary appropriations shall relieve a unit of local government of the obligation to implement any State mandate. Defines "State mandate". Effective upon being declared adopted.

5 | CONCURRING HEREIN, that there shall be submitted to the | |||||||||||||||||||

7 | election next occurring at least 6 months after the adoption of | |||||||||||||||||||
8 | this resolution a proposition to amend the Illinois | |||||||||||||||||||
9 | Constitution by adding Section 5 to Article VIII as follows:

13 | SECTION 5. STATE MANDATES | |||||||||||||||||||
14 | (a) Any State mandate regarding any subject matter that | |||||||||||||||||||
15 | necessitates additional expenditures from the revenues of | |||||||||||||||||||
16 | units of local government shall be void and unenforceable | |||||||||||||||||||
17 | unless the General Assembly makes necessary appropriations to | |||||||||||||||||||
18 | implement that mandate. The failure of the General Assembly to | |||||||||||||||||||
19 | make necessary appropriations shall relieve a unit of local | |||||||||||||||||||
20 | government of the obligation to implement any State mandate. | |||||||||||||||||||
21 | (b) For the purposes of this Section, "State mandate" means | |||||||||||||||||||
22 | any State-initiated statutory or executive action that | |||||||||||||||||||
23 | requires a local government to establish, expand, or modify its |

4 | This Constitutional Amendment takes effect upon being | ||||||
5 | declared adopted in accordance with Section 7 of the Illinois | ||||||
6 | Constitutional Amendment Act.
