Synopsis: Statute of limitations on land surveys. Provides that if a land surveyor or property owner of land surveyed provides a copy of a survey to owners of contiguous property, any statute of limitation for contesting the survey begins to run from the time the survey is provided to the owners of the contiguous property.

Effective: July 1, 2013.

HOUSE BILL No. 1058



    A BILL FOR AN ACT to amend the Indiana Code concerning civil procedure.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 34-11-3-2; (13)IN1058.1.1. -->     SECTION 1. IC 34-11-3-2 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 2. (a) When a land surveyor completes a survey, if the surveyor or the owner of the property surveyed provides a copy of the survey to the owners of property contiguous to the land that is the subject of the survey, any statute of limitation in law concerning contesting the survey begins to run from the date the survey is provided to the owners of contiguous property who have received the copies.
     (b) If copies of a survey are provided under subsection (a), the copies shall be provided in the manner prescribed in the rules of civil procedure for the service of process.
    (c)
Nothing in this section requires a land surveyor or the owner of the land surveyed to provide copies of the survey to the owners of contiguous property.
