A HOUSE RESOLUTION urging the Legislative Council
to assign to the appropriate study committee the topic of 811
laws in Indiana.
Whereas, 811 laws are designed to prevent damage to
property and injury to individuals by requiring contractors
conducting excavations to determine the location of
underground resources and utilities before beginning work;
Whereas, The location of underground resources and
utilities are determined with the help of a statewide database of
facility locations that is created in part using information
provided by the utilities; and
Whereas, If utility companies do not correctly identify the
location of their underground facilities, the usefulness of 811
laws is mitigated, and contractors and members of the general
public may be at risk of injury: Therefore,
SECTION 1. That the Indiana House of Representatives urges the Legislative Council to assign to the appropriate committee the topic of the effectiveness of the 811 laws in Indiana, with particular focus on how current law may be modified to increase worker safety and ensure an equitable distribution of responsibility between contractors and utility providers for fulfilling the laws' requirements.
