    A BILL FOR AN ACT to amend the Indiana Code concerning public safety.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 16-31-3-3.5; (11)IN0089.1.1. -->     SECTION 1. IC 16-31-3-3.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2011]: Sec. 3.5. (a) As used in this section, "limited criminal history" has the meaning set forth in IC 10-13-3-11.
    (b) For purposes of this section, "person" means a person that:
        (1) furnishes, operates, conducts, maintains, advertises, or otherwise is engaged in providing emergency medical services as part of the regular course of doing business, on either a paid or volunteer basis; and
        (2) employs individuals who are required to be certified under this chapter.
    (c) A person shall require the person's employees to meet the requirements set forth in subsections (d) and (e).
    (d) Every individual who:
        (1) becomes an employee of a person after June 30, 2011; and
        (2) is required to be certified under this chapter;
shall, before beginning to provide emergency medical services as

an employee of a person, provide to the person a limited criminal history from each state in which the individual resided within the prior five (5) years.
    (e) Every individual who:
        (1) is currently employed by a person;
        (2) became an employee of the person before July 1, 2011; and
        (3) is required to be certified under this chapter;
shall provide to the person a limited criminal history from the state police department, as official central repository for criminal history data under IC 10-13-3-24, dated not later than December 31, 2011.
    (f) This section does not apply to an individual who does not provide emergency medical services other than by using an automated external defibrillator.
    ( g) Each person shall maintain the criminal history provided by each individual required to provide a criminal history under subsection (d) or (e) in the primary business office of the person for a period of five (5) years from the date the criminal history is provided. Each person shall make the criminal histories maintained under this subsection available to representatives of the emergency medical service commission or the Indiana department of homeland security upon request.

    (b) A totally sprinkled building (conforming to Uniform Building Code standards the Indiana Building Code (675 IAC 13) at the time of construction) is exempt from the requirements of this chapter.
