Synopsis: Use of DNA evidence. Permits, subject to Combined DNA Index System (CODIS) guidelines, the superintendent of the state police department to authorize the investigation of a person genetically related to an individual whose DNA profile is stored in the Indiana DNA data base if the results of a DNA test conducted on a DNA sample as part of a criminal investigation: (1) do not show an exact match between the DNA sample and the DNA profile stored in the data base; but (2) show that the DNA sample matches the DNA profile stored in the data base so closely as to suggest that a person genetically related to the individual whose DNA profile is stored in the data base may be a suspect.

Effective: July 1, 2013.

    A BILL FOR AN ACT to amend the Indiana Code concerning corrections.

Be it enacted by the General Assembly of the State of Indiana:

SOURCE: IC 10-13-6-13.5; (13)IN0118.1.1. -->     SECTION 1. IC 10-13-6-13.5 IS ADDED TO THE INDIANA CODE AS A NEW SECTION TO READ AS FOLLOWS [EFFECTIVE JULY 1, 2013]: Sec. 13.5. If a DNA analysis conducted on a DNA sample as part of a criminal investigation:
        (1) does not establish an exact match between the DNA sample and the DNA profile of an individual whose DNA record is stored in the Indiana DNA data base; and
        (2) indicates that the DNA sample so closely matches the DNA profile of an individual whose DNA record is stored in the data base as to reasonably suggest that the DNA sample comes from a person who is genetically related to the individual whose DNA record is stored in the data base;
the superintendent may, subject to the Combined DNA Index System (CODIS) guidelines on the use of a DNA record established by the Federal Bureau of Investigation, authorize an investigation of one (1) or more persons who are genetically related to the individual whose DNA records are stored in the data base.
