Synopsis: Turnaround academies. Requires the state board of
education to enter into a contract with a special management team
before assigning the team to a turnaround academy. Sets forth the
responsibilities and duties that must be included in the contract and the
principles that must be followed in establishing performance indicators.

Chapter 9.7. Turnaround Academies: Management and Oversight Contracts
Sec. 1. Before the state board assigns a special management team to operate a turnaround academy, the state board and the special management team shall enter into a contract that includes provisions concerning the following responsibilities and duties concerning the turnaround academy:
(1) Performance expectations, including the following:
(A) The length of the contract.
(B) The methods and standards by which the special management team's performance is to be evaluated, including:
(i) performance indicators, focuses, and goals that are specific for the turnaround academy;
(ii) monitoring; and
(iii) the frequency and content of reports to the state board and the public.
(C) The consequences for failing to meet performance targets, including termination of the contract.
(D) The criteria for contract renewal.
(2) The assignment of responsibility for management functions, including the following:
(A) Performance or incentive pay.
(B) Curriculum design and implementation.
(C) Daily and yearly schedules.
(D) Program modification, elimination, or creation.
(E) Nonacademic student support services.
(F) The ability to raise additional funds.
(G) Food service.
(3) Legal issues, including the following:
(A) Intellectual property rights.
(B) A prohibition against the assignment of any duty or responsibility included in the contract, unless the assignment is specifically authorized.
(C) Liability.
(D) Confidentiality.
(E) Jurisdiction.
Sec. 2. The performance indicators under section 1(B)(i) of this chapter must incorporate the following principles:
(1) The performance indicators are based on factors known to succeed in schools similar to the turnaround academy.
(2) The performance indicators change to predict success at each stage of reform, with:
(A) initial indicators based on data available at the beginning of the stage;
(B) specific goals established for the stage; and
(C) the steps necessary to achieve the goals based on the situation at the turnaround academy.
(3) A specific timetable is established for each performance indicator.
