SENATE RESOLUTION No. 24


     MADAM PRESIDENT:

    I offer the following resolution and move its adoption:

    A SENATE RESOLUTION urging the Legislative Council to assign an interim study committee the topic of tree trimming.

    Whereas, Indiana values its natural environment;

    Whereas, Indiana values private property rights;

    Whereas, The excessive removal of tree canopy with respect to a utility right of way mars the natural environment and infringes upon the rights of landowners; and

    Whereas, Not all utilities are subject to the rules of the Utility Regulatory Commission concerning tree trimming: Therefore,

Be it resolved by the Senate of the

General Assembly of the State of Indiana:


    SECTION 1. That the Indiana Senate urges the Legislative Council to assign an interim study committee the topic of whether additional regulatory actions are necessary to prevent excessive removal of tree canopy from utility right of ways .
    SECTION 2. The Secretary of the Senate is hereby directed to transmit a copy of this resolution to the Legislative Council through the Executive Director of the Legislative Services Agency.
