An Act to close automatic weapon loopholes.



                Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

            Section 121 of chapter one hundred forty of the general laws is hereby amended by deleting in line 20 the following: “(i) any of the weapons, or replicas or duplicates of such weapons, specified in appendix A to 18 U.S.C. section 922 as appearing in such appendix on September 13, 1994, as such weapons were manufactured on October 1, 1993; (ii) any weapon that is operated by manual bolt, pump, lever or slide action;”.

SECTION 2 – Subsection (a) of section 131 of chapter one hundred forty of the general laws is hereby amended by inserting after the word “firearms” in line 6 the following: “other than assault weapons”.

SECTION 3 – Subsection (a) of section 131 of chapter one hundred forty of the general laws is hereby amended by inserting after the word “weapons” in line 9 the following: “other than assault weapons”.

SECTION 4 – Subsection (a) of section 131 of chapter one hundred forty of the general laws is hereby amended by deleting in line 48 the following: “(v) hunting in accordance with the provisions of chapter 131”.

SECTION 5 – Subsection (a)(6) of section 10 of chapter two hundred sixty-nine of the general laws is hereby amended by deleting in line 29 the following: “not less than two and one-half years nor more than five years, or for not less than one year nor more than two and one-half years in a jail or house of correction” and inserting in place thereof the following:       

“not less than three years”.

SECTION 6 – Subsection (a)(6) of section 10 of chapter two hundred sixty-nine of the general laws is hereby amended by inserting in line 36 after the word “sentence” the following:         

“, nor shall such sentence be served concurrently with any other sentence”.

SECTION 7 – Subsection (a) of section 10G of chapter two hundred sixty-nine of the general laws is hereby amended by deleting in line 4 the following: “three” and inserting in place thereof the following: “five”.

SECTION 8 – Subsection (d) of section 10G of chapter two hundred sixty-nine of the general laws is hereby amended by inserting in line 22 after the word “sentence” the following:         

“, nor shall such sentence be served concurrently with any other sentence”.
