An Act to criminalize the attempted production of Class B drugs.
Be
it enacted by the Senate and House of Representatives in General Court
assembled, and by the authority of the same, as follows:
SECTION 1. Section 32A of Chapter 94C of the General Laws is hereby amended by inserting at the end of the first paragraph the following: “; provided, that possession with intent to manufacture shall include possession of the constituent ingredients; provided further, that simple possession of the constituent ingredients shall constitute neither proof nor presumption of intent to manufacture.”
