HOUSE BILL No. 4005

 

 

January 9, 2019, Introduced by Reps. Hope, Filler and Anthony and referred to the Committee on Judiciary.

 

     A bill to amend 1921 PA 352, entitled

 

"An act to prohibit the marriage of a person under 16 years of age

and to declare the marriage void,"

 

by amending section 1 (MCL 551.51), as amended by 1983 PA 198.

 

THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

 

     Sec. 1. (1) A marriage in this state shall not be contracted

 

by a person who is under 16 years of age, and the marriage, if

 

entered into, shall be void. This act shall not prohibit probate

 

judges from exercising their powers to perform marriages as

 

provided by Act No. 180 of the Public Acts of 1897, being sections

 

551.201 to 551.204 of the Michigan Compiled Laws.Until December 31,

 

2019, a marriage in this state shall not be contracted by a person

 

who is under 16 years of age, and the marriage, if entered into, is

 

void. This act does not prohibit a probate judge from exercising

 

his or her power to perform a marriage as provided by 1897 PA 180,


MCL 551.201 to 551.204.

 

     (2) Beginning January 1, 2020, marriage in this state shall

 

not be contracted by a person who is under 18 years of age, and the

 

marriage, if entered into by a person who is under 18 years of age,

 

is void. This act does not prohibit a probate judge from exercising

 

his or her power to perform a marriage as provided by 1897 PA 180,

 

MCL 551.201 to 551.204.

 

     Enacting section 1. This amendatory act takes effect 90 days

 

after the date it is enacted into law.

 

     Enacting section 2. This amendatory act does not take effect

 

unless all of the following bills of the 100th Legislature are

 

enacted into law:

 

     (a) Senate Bill No.____ or House Bill No. 4003 (request no.
