A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 638 (MCL 257.638).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Sec. 638. (1) A vehicle shall not be driven to the left side
of the center of a 2-lane highway or in the center lane of a 3-lane
highway in overtaking and passing another vehicle proceeding in the
same direction unless the left side or center lane is clearly
visible and is free of oncoming traffic for a sufficient distance
ahead to permit the overtaking and passing to be completely made
without interfering with the safe operation of a vehicle
approaching from the opposite direction or the vehicle overtaken.
(2) The driver of a vehicle that is overtaking and passing
another vehicle proceeding in the same direction in the manner
described in subsection (1) may exceed the speed limit for the
portion of highway upon which that vehicle is traveling, subject to
all of the following:
(a) The driver may exceed the speed limit by no more than 10
miles per hour.
(b) The driver may only exceed the speed limit during the
period of time that he or she is overtaking and passing the other
vehicle as described in subsection (1) and for no longer than 10
seconds after he or she has safely overtaken and passed the other
vehicle.
(c) This subsection only applies while the vehicle is
traveling on a portion of a highway that is not within the limits
of a village or city or within a school zone.

A person who violates this section
is responsible for
a civil infraction.
Enacting section 1. This amendatory act takes effect 90 days
after the date it is enacted into law.
