HOUSE BILL NO. 4214
A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding part 95A.
the people of the state of michigan enact:
PART 95A
TRIGGER LOCK DISTRIBUTION PROGRAM
Sec. 9521.(1) As used in this part:
(a) "Health professional" means an individual licensed, registered, or otherwise authorized to engage in a health profession under article 15.
(b) "Hospital" means that term as defined in section 20106.
(c) "Parent" means a natural parent, stepparent, adoptive parent, legal guardian, or legal custodian of an infant.
(d) "Trigger lock" means a commercially available trigger lock or other device designed to disable a firearm and prevent the discharge of a firearm.
(2) In addition, article 1 contains general definitions and principles of construction applicable to all articles in this code.
Sec. 9523. (1) All of the following shall provide to a parent or expecting parent, as applicable, a trigger lock and the educational and instructional materials described in subsection (2), in the following time frames:
(a) A hospital or local health department, after the expectant parent's completion of a childbirth education class held at the hospital or local health department.
(b) A hospital, after the birth of the parent's infant in the hospital.
(c) After an infant's birth by either of the following:
(i) If the infant is born in a setting other than in a hospital, the health professional in charge at the birth of the parent's infant.
(ii) If the infant is born in a setting other than in a hospital and there is no health professional in charge at the birth of the parent's infant, the health professional in charge of the care of the infant.
(d) If a health professional provides well-baby visits to the parent's infant, the health professional at each well-baby visit through the infant's 6-month well-baby visit.
(2) The department shall develop, adopt, or approve educational and instructional materials on trigger locks. The materials described in this subsection must be written in easily understandable language and explain the possible risks associated with unlocked firearms to minors.
(3) The department shall provide, at no cost, to hospitals, local health departments, and health professionals the educational and instructional materials described in subsection (2) and trigger locks. The department shall also make the materials described in subsection (2) available to the public by posting the materials on the department's website.
Sec. 9524. (1) The trigger lock distribution fund is created in the state treasury.
(2) The state treasurer shall deposit money and other assets received from any source in the fund. The state treasurer shall direct the investment of money in the fund and credit interest and earnings from the investments to the fund.
(3) The department is the administrator of the fund for audits of the fund.
(4) The department shall expend money from the fund on appropriation only for the purpose of implementing this part.
Sec. 9525. A hospital, local health department, or health professional that provides a trigger lock under this part shall provide data on the number of trigger locks provided to parents and expectant parents in a format and manner required by the department.
