A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding part 166.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
PART 166. STATE RECYCLING PROGRAM
Sec. 16601. As used in this part:
(a) "Recyclable" means able to be readily introduced into a
stream of material for which there is a well-established market for
reuse or recycling or able to be returned for a refund under 1976
IL 1, MCL 445.571 to 445.576.
(b) "State agency" means the legislature, a state court, a
state university, or any other agency, department, board,
commission, or council of this state.
Sec. 16603. (1) A state agency that conducts an event open to
the public at which beverages are provided in recyclable containers
of plastic, aluminum, or glass shall ensure that receptacles
specifically designated for the collection of those containers are
conveniently available on the premises where the event is held.
(2) A state agency described in subsection (1) shall ensure
that a reasonable effort is made to transfer beverage containers
deposited in receptacles required under subsection (1) to an
appropriate location for reuse, recycling, or return for a deposit.
(3) If a state agency contracts with a person to conduct an
event described in subsection (1) for the state agency, the
contract shall contain terms to ensure compliance with subsections
(1) and (2).
(4) Subsections (1) to (3) do not apply to either of the
following:
(a) An event conducted by a person under a contract with a
state agency entered into before the effective date of this
section.
(b) An event at which all beverages provided in recyclable
containers of plastic, aluminum, or glass are provided by vending
machine.
